Councilmember Peterson introduced the following resolution and moved for its adoption: RESOLUTION #91-04-085 RESOLUTION ADOPTING FINDINGS OF FACT TO AMEND BUSINESS AND RESIDENTIAL ZONING BOUNDARIES IN FAYE ADDITION NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That Faye Construction, hereinafter referred to as "Applicant", has properly applied for a rezoning to realign the boundaries of the Residential and Business zones within the plat of Faye Addition. 2) That the Planning and Zoning Commission conducted a public hearing pursuant to Section 9.03.03 of the City Code on March 5, 1991 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. 3) That the amended zoning boundaries for the R-1 Residential and B~3/B-1 business Districts within the plat of Faye Addition are proposed as follows: B-3/B-1 - All of land within Faye Addition northerly of a line commencing on the west boundary of the Addition at the south line of Lot 1, Block 5 and extending easterly along that line and the south line of Lot 1, Block 2 and Lot 1, Block 4 to the intersection with the east boundary of the Faye Addition. R-1 Residential - All of the land within Faye Addition southerly of the B- 3/B- 1 District boundary described above. 4) That the total area of Faye Addition is 103 acres. 5) That the subject plat is bounded on the north by Highway gl0, on the south by the Mississippi River, on the east by B-3 Business and R-1 Urban Residential zones, and on the west by Anoka County Park property. 6) That the Applicant is proposing to develop Faye Addition with a combination of single family homes and commercial development that will be served by sanitary sewer and municipal water. 7) That the subject property is located within the City's Urban Area but a portion of the subject property is located outside the 1990 Urban Area. 8) That on January 26, 1989, the City of Ramsey submitted a formal application to the Metropolitan Council for a Comprehensive Plan amendment for a MUSA boundary expansion, Phase II of which would facilitate developing the entire property known as Faye Addition in accordance with urban standards. 9) That on July 13, 1989, the City of Ramsey received Metropolitan Council approval of a Comprehensive Plan Amendment to expand the MUSA boundary, with Phase II of the expansion being contingent upon submittal of additional documents. Final approval of Phase II MUSA expansion remains pending at the writing of these findings of fact.
