Councilmember Beyer introduced the following resolution and moved for its adoption: RESOLUTION 91-04-087 RESOLUTION DECLARING CONDITIONS OF CONDITIONAL USE PERMIT FOR AN ALUMINUM PROCESSING PLANT WHEREAS, the Ramsey City Council adopted Resolution g91-04-086, regarding Findings of Fact for this use and herein approves a Conditional Use Permit subject to the following conditions. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On April 23, 1991, a conditional use permit ("CUP") was issued by the City of Ramsey ("City") to Aluminum Recycling Processing, Inc. ("Permit Holder") to operate an aluminum processing plant in the B/W Business Warehouse District on approximately 2.58 acres of land legally described as follows: Lot 2, Block 1, Gateway North Industrial Park Plat 1. Subsequent to that, the Permit Holder assigned its interest to Alloy Recovery Company. This permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this permit are as follows: Term. This permit shall remain in effect so long as the conditions imposed herein are complied with. Noise. Noises emanating from the site and operations shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules 7010.0010 to 7010.0080, as amended except as modified herein by City performance requirements. Dust/Ash/Particulates. The emission of dust, ash or other particulates matter shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules 7005.0010 - 7005.0080, 7005.2770 subp. 2.A., and 40 CFR Part 50 as amended except as modified herein by City performance requirements. Odor. The emission of odor from the operation shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules 7005.0920, as amended except as modified herein by City performance requirements. Smoke. The emission of smoke from the operation shall be in compliance with and regulated by the State of Minnesota Pollution Control standards, Minnesota Regulation 7005.0480 subp. 1.B., as amended except as modified herein by City performance requirements. Furnace Emissions and Monitoring. Emissions from the melt furnace shall comply with State and Federal regulations as they exist and may be modified from time to time during the period of this CUP. An independent testing laboratory shall conduct emissions monitoring at least once per year and on a more frequent basis if pollutants are in excess of standards. The Permit Holder shall make a complete report available to the City within thirty (30) days of completion by the testing laboratory. At a minimum, the parameters of such emissions monitoring shall include the following State and Federal criteria pollutant emissions as may exist from time to time during the term of this permit. The cost of such testing and reports shall be borne by the Permit Holder.
