This permit and the performance of the owner/operation shall <br />be reviewed annually by the City Council at least 60 days prior to the <br />anniversary date of the permit date. Required insurance certificates and <br />appropriate bonds shall be submitted to the City prior to the anniversary date <br />of the permit. <br /> <br />On-Site Inspection. The City reserves the right to inspect the site for the <br />purposes of examining and copying non-privileged records; conducting <br />inspections, surveys, investigations, monitoring or sampling; and. obtaining <br />necessary information pertaining to the construction, operation and <br />environmental effect of the recovery and treatment operations. Inspections <br />shall be conducted during normal business hours .except in the event of an <br />emergency. City personnel or agents performing the inspection will notify <br />personnel at the landfill office at the time of inspection. <br /> <br />Indemnity, WMMI shall indemnify, defend and hold the City harmless from all <br />claims, demands and/or actions legal and/or equitable arising from the <br />operations. Upon commencement of this CUP, WMMI shall deliver to the City <br />an executed indemnification agreement in the form of Exhibit A attached <br />hereto. <br /> <br />Documents and Maps. Copies of all test results, pertinent correspondence from <br />the Permit Holder and to the Permit Holder from regulatory agencies, and all <br />documents, reports and plans which are required to be supplied to the MPCA, <br />Anoka County or other governmental agencies shall also be supplied <br />concurrently to the City at no cost to the City. <br /> <br />Screening. The Permit Holder shall submit a landscape screening plan to the <br />City for approval prior to commencing operations at the treatment facility. The <br />screening plan shall indicate species, size, location, number of plants and any <br />grading that may be done for screening. Screening of the treatment facility <br />shall be such that within five years of planting, 75% of opacity is achieved to <br />a height of 20' from a base elevation of 870'. The minimum size of screening <br />material shall be five foot in height. <br /> <br />Odor, Noise, Nuisance Control. The Permit Holder shall comply with the <br />performance standards of the City Code (170.017), state and federal <br />regulations as may be amended or revised over the term of this permit. <br /> <br /> <br />
