Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #91-05-124 <br /> <br />RESOLUTION APPROVING ACQUISITION OF UTILITY PROPERTY WITHIN <br />TAX INCREMENT FINANCING DISTRICT NO. 5 <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA as follows: <br /> <br />Section 1. Recitals. <br /> <br />1.01. <br /> <br />This Council approved a modified Development Program for Development District No. 1 <br />("Development District") and a Tax Increment Financing Plan CTIF Plan") for Tax <br />Increment Financing District No. 5 ("TIF District") by resolution dated April 24, 1990, <br />pursuant to Minnesota Statutes Section 469.174 to 469.178 CTIF Act"). <br /> <br />1.02. <br /> <br />Pursuant to the TIF Plan, the City intends to construct water and sewer lines and other <br />public improvements ("Utilities") to serve residential development within the TIF District, <br />assess the costs of such Utilities pursuant to Minnesota Statutes Chapter 429, and <br />reimburse the developers for a portion of such costs through payments of tax increment <br />from the TIF District. <br /> <br />1.03. <br /> <br />The City conducted an improvement hearing regarding the Utilities pursuant to Minnesota <br />Statutes, Chapter 429 on June 12, 1990, and subsequently ordered the City Engineer to <br />prepare plans and specifications for the Utilities. <br /> <br />1.04. <br /> <br />The City has determined that, in order to implement plans for construction of the Utilities in <br />accordance with the TIF Plan, it is necessary to acquire property in the form of an easement <br />for the Utilities (the "Utility Property"), which Utility Property is located within the TIF <br />District. <br /> <br />1.05. The Utility Property consists of a 60-foot wide easement as more specifically described in a <br /> quit claim deed (the "Deed") to be granted to the City by Good Value Homes, Inc. <br /> <br />Section 2. Acquisition Approved. <br /> <br />2.01. Acquisition of the Utility Property by the City is hereby approved at a purchase price <br /> deemed satisfactory to the City Engineer. <br /> <br />2.02. City Officials are authorized and directed to take all appropriate actions to consummate the <br /> above described acquisition. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Beyer and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gilbertson <br />Councilmember Peterson <br />Councilmember Beyer <br />Councilmember Hardin <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br /> <br />
