Mayor Gilbertson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #91-07-159 <br /> <br />RESOLUTION VACATING THE NORTH 320 FEET OF OUTLOT B, <br />COUNTRYSIDE ESTATES <br /> <br /> WHEREAS, Outlot B, Countryside Estates was dedicated to the public as a park pursuant <br />to the 1972 plat which was accepted and approved by the then Ramsey Township; and <br /> <br /> WHEREAS, through a series of errors by the developer of the plat, the City of Ramsey, <br />Anoka County, a builder, and a title company, a house was permitted to be constructed on the <br />North 320 feet of Outlot B, Countryside Estates; and <br /> <br /> WHEREAS, it is not economically feasible, perhaps not legally feasible, to require that <br />the house be removed from said North 320 feet of Outlot B; and <br /> <br /> WHEREAS, the City's Planning and Zoning Commission has recommended the vacation <br />of the North 320 feet of said Outlot B; and <br /> <br /> WHEREAS, the City Council finds that it appears in the interest of the public to vacate <br />the North 320 feet of Outlot B, Countryside Estates; and <br /> <br /> WHEREAS, the City's Planning and Zoning Commission conducted a public hearing on <br />the proposed vacation on June 3, 1991, as required by MS 412.851, which notice of public <br />hearing was properly published and written notice properly given; and <br /> <br /> WHEREAS, City Charter Section 12.06 requires that public grounds may be vacated <br />only by ordinance; and <br /> <br /> WHEREAS, the City Council, on June 25, 1991, introduced an ordinance vacating the <br />North 320 feet of Outlot B, Countryside Estates. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City Council hereby adopts an ordinance which shall vacate the North 320 feet of <br />Outlot B, Countryside Estates, Anoka County, Minnesota. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />?eterson and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gilbertson <br />Councilmember Peterson <br />Councilmember Hardin <br />Councilmember Beyer <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br /> <br />
