Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #91-08-197 <br /> <br />RESOLUTION AUTHORIZING THREE-FOURTHS (3/4) COMMISSIONERS' AWARD <br />FOR CONDEMNATION PAYMENT TO HARRIS E. HAUGTVEDT AND GRACE M. <br />HAUGTVEDT REGARDING IMPROVEMENT PROJECT #89-4 (EXTENSION OF <br />153RD AVENUE N.W.) <br /> <br /> WHEREAS, the Condemnation Commissioners awarded $18,000.00 as damages to the <br />owners of condemnation Parcel #9, City Improvement Project #89-4, which is PIN 22-32-25-24-0001; <br />and <br /> <br />WHEREAS, the owners have appealed to District Court the $18,000.00 award; and <br /> <br /> WHEREAS, State Statute requires that pending the District Court appeal, the property owners <br />are entitled to three-fourths (3/4) of the Commissioners' award; and <br /> <br />WHEREAS, the City has previously paid these owners the sum of $7,700.00. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City's Finance Officer is directed to issue a City check to Harris E. Haugtvedt, Grace M. <br />Haugtvedt, Siegel, Brill, Greupner & Duffy, P.A., their attomeys, and First Union Home Equity <br />Corporation which check shall be in the amount of $5,800.00. The $5,800.00 plus the <br />previously paid $7,700.00 equals three fourths of $18,000.00, or $13,500.00 <br /> <br /> The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Cich and <br /> upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Gilbenson <br /> Councilmember Peterson <br /> Councilmember Cich <br /> Councilmember Hardin <br /> Councilmember Beyer <br /> <br /> and the following voted against the same: <br /> <br /> None <br /> <br /> and the following abstained: <br /> <br /> None <br /> <br /> and the following were absent: <br /> <br /> None <br /> <br /> whereupon said resolution was declared duly passed and adopted by the CityC~ the 27thorny of <br /> <br /> y yor <br /> ,AT.TEST: f) } /~ <br /> <br />'EqtyDA~[mini~trator -' <br /> <br /> <br />
