Councilmember Cich introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #91-08-200 <br /> <br />A RESOLUTION DECLARING CONDITIONS OF CONDITIONAL USE PERMIT <br />FOR AN OUTSIDE DISPLAY AREA <br /> ASSOCIATED WITH A MOTOR VEHICLE SALES LOT <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution #91-08-199, regarding <br />Findings of Fact for this use and herein approves a Conditional Use Permit subject to the following <br />conditions. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On August 27, 1991, a conditional use permit ("CUP") was issued by the City of Ramsey ("City") <br />to Jim Provinzino ("Permit Holder") to establish an outdoor display/sales area in the B-3 Business <br />District on approximately one-half acre of land generally known as 6304 Hwy. #10 N.W. and <br />legally described as follows: <br /> <br />That part of Lot 12, Auditor's Subdivision Number 96 lying Northeasterly of a line parallel <br />with and 190 feet Southwesterly of Southwesterly line of State Trunk Highway No. 10 <br />more particularly described as follows: That part of Government Lot 1, Section 25, <br />Township 32, Range 25 described as follows: To-wit, commencing at a point of <br />intersection of Southwesterly line of State Trunk Highway No. 10 and Northwesterly line <br />of Poplar Drive (aka Tungsten Street N.W.) according to plat of Dickenson's Mississippi <br />Estate of record and on file in Office of Registrar of Deeds, Anoka County, Minnesota, <br />thence Northwesterly along said Southwesterly highway line a distance of 400 feet to actual <br />point of beginning of land to be described; thence continuing along last described Highway <br />line a distance of 100 feet; thence Southwesterly along a line parallel with Northwesterly <br />line of said Poplar Drive to a point of intersection with line parallel with and distant 502.74 <br />feet East at right angles to West line of said Government Lot 1; thence South along a line <br />parallel with and distant 502.74 feet East at right angles to said West line of Government <br />Lot 1 to a point of intersection with a line parallel with and 190 feet Southwesterly of <br />Southwesterly line of State Highway; thence Southeasterly along said line parallel with and <br />190 feet Southwesterly of Southwesterly line of said State Highway to a point of <br />intersection with a line extended Southerly being parallel with and distant 400 feet <br />Northwesterly as measured along said Southwesterly line of State Highway from said <br />Northwesterly Line of said Poplar Drive (aka Tungsten Street N.W.); thence Northeasterly <br />and parallel with said Poplar Drive (aka Tungsten Street N.W.) to actual point of <br />beginning. <br /> <br />This permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this <br />permit are as follows: <br /> <br />This permit shall remain in effect so as the conditions imposed herein are complied .with <br />except that the permit cannot be transferred without the prior expressed approval of the <br />Ramsey City Council. <br /> <br />The subject property shall be permitted for an outdoor display/sales area that will <br />accommodate a maximum of twenty-three (23) vehicles. <br /> <br />The outdoor display area shall maintain a ten (10) foot setback from the front property line <br />of the subject property. <br /> <br /> <br />
