Councilmember Peterson introduced the following resolution and moved for its adoption <br /> <br />RESOLUTION #91-10-228 <br /> <br />RESOLUTION AUTHORIZING 1991 BUDGET AMENDMENT #5 FOR THE <br />PURPOSE OF ADOPTING A LEGAL SERVICES BUDGET FOR THE LANDFILL <br />EXPENDABLE TRUST FUND <br /> <br /> WHEREAS, at the regular Council meeting of August 13, 1991, staff gave a report on the <br />Waste Management of Minnesota, Inc. Tipping Fee Disparity; and <br /> <br /> WHEREAS, Waste Management of Minnesota, Inc.'s deduction for Closure/Post <br />Closure from the Anoka Sanitary Landfill revenue has reduced revenue to each of the Cities of <br />Ramsey and Anoka in the amount of $89,354 for the years of 1990 and 1991 (for payments <br />received through September 20, 1991); and <br /> <br /> WHEREAS, this deduction could substantially reduce revenue to the Landfill Expendable <br />Trust Fund in future years; and <br /> <br /> WHEREAS, the Ramsey City Council reaffirmed previous discussions wherein it was <br />agreed that the Cities of Ramsey and Anoka should jointly pursue collection of Waste Management <br />of Minnesota, Inc.'s Closure/Post Closure deduction from the Anoka Sanitary Landfill revenue; <br />and <br /> <br /> WHEREAS, the City Attorneys for Ramsey and Anoka have estimated the cost to serve a <br />Summons of Complaint against Waste Management of Minnesota, Inc. to not exceed $5,000.00 <br />per City. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City Administrator is authorized to expend funds in an amount not to exceed <br />$5,000.00 for the purpose of pursuing collection of revenues due the City of Ramsey. <br /> <br />2) That such expenditures will be funded from the Landfill Expendable Trust Fund. <br /> <br />3) <br /> <br />That the City's Finance Officer be instructed to enter this Budget Amendment #5 to the City <br />of Ramsey's Financial Systems for the purpose of establishing a legal services budget in <br />the amount of $5,000.00 for the Landfill Expendable Trust Fund. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Cich and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gilbertson <br />Councilmember Peterson <br />Councilmember Cich <br />Councilmember Beyer <br />Councilmember Hardin <br /> <br />and the following voted against same: <br /> <br />None <br /> <br /> <br />
