Observations: City staff reviewed attached updated MnDOT Cooperative Construction Agreement # 1052605 and has no concerns or comments. The only difference between the attached updated version and the version approved by the City Council on September 12th is the addition of new sections 4.7, 4.8, 4.9 and 4.10 outlining requirements and responsibilities by and between Anoka County and MnDOT for a project field office. Also, the City's signature page is now included as page 17. The City Attorney reviewed the attached updated MnDOT Cooperative Construction Agreement # 1052605 and has approved the agreement as to legal form. As with the previously approved original agreement, upon approving updated MnDOT Cooperative Construction Agreement # 1052605, the City will be responsible for maintaining all infrastructure identified in attached exhibits A, B, C, D, and E after construction is complete and the City has accepted the project. This is similar to the responsibilities assumed by the City following the completion of construction of the Armstrong Boulevard Interchange. Funding Source: As defined within attached updated MnDOT Cooperative Construction Agreement # 1052605, the City is responsible for paying the State $11,021.57 for the City's share of the State's costs of the construction engineering in connection with the City water main and sanitary sewer construction. This cost remains unchanged from the original agreement approved on September 12th. Recommendation: Staff recommends approving updated MnDOT Cooperative Construction Agreement # 1052605.
