Prior to issuance of any such permit, the <br />2 <br />zoning authority may require that soil boring tests be done on the proposed site to determine <br />3 <br />whether or not the site is capable of supporting a conforming sewage treatment system. <br />4 <br />5I <br />tCy :I: nether <br />I % %A 1 16 1 standaids Ier water qua', I %a Ing E-41 IhI e administrative procedures elf, app,l,Gable_ <br />7 <br />8 <br />956 <br />Placement of Structures <br />9 <br />10 <br />(A) <br />Structures proposed within a floodplain area shall be consistent with all floodplain management <br />11 <br />regulations of the city. <br />12 <br />(B) <br />No structure shall be placed on any slope greater than 12 percent (12 feet vertical rise in 100 feet <br />13 <br />horizontal distance) unless such structures can be screened. Sewage disposal facilities can be <br />14 <br />installed so as to comply with the sanitary provisions of section 955, and the permit applicant can <br />15 <br />prove to the zoning authority that any potential erosion or sedimentation problems related to <br />16 <br />locating such a structure either do not exist, or that adequate measures will be taken to prevent <br />17 <br />such problems through special construction methods. <br />18 <br />19 <br />957 Subdivision of Land in Scenic River Overlay District <br />20 <br />21 <br />(A) <br />No land shall be subdivided which is determined by the city, or the commissioner of natural <br />22 <br />resources, to be unsuitable by reason of flooding, inadequate drainage, soil and rock formations <br />23 <br />with severe limitations for development, severe erosion potential, unfavorable topography, <br />24 <br />inadequate water supply or sewage treatment capabilities or any other feature likely to be harmful <br />25 <br />to the health, safety, or welfare of the future residents of the proposed subdivision or the <br />26 <br />community. Soil percolation rate tests and soil borings shall be required on each proposed <br />27 <br />subdivision within the Rum Scenic River Land Use District, to establish the suitability of the land for <br />28 <br />development. Such testing is required before any final plat may be approved, but may be waived <br />29 <br />by the zoning administrator when adequate data is already available. <br />30 <br />(B) <br />Planned unit or cluster developments may be allowed in the Scenic River Land Use District if <br />31 <br />preliminary plans are first approved by the commissioner of natural resources and the applicable <br />32 <br />provisions of Minn. Rules pts. 6105.0010-6105.0250 pertaining to such development are satisfied, <br />33 <br />and the provisions of this Code are satisfied. <br />34 <br />35 958 Landscape Alterations <br />36 Vegetative cutting. <br />37 (1) The vegetative cutting provisions of this section shall apply to those areas as specified in <br />38 section 954. <br />39 (2) General provisions within designated setback areas: <br />40 a. Clear -cutting, except for any authorized public services such as roads and utilities, shall <br />41 not be permitted. <br />42 b. Selective cutting of trees in excess of four inches in diameter at breast height shall be <br />43 permitted providing cutting is spaced in several cutting operations and a continuous <br />44 cover is maintained. <br />45 C. The cutting provisions of subsections (a)(2)a and b of this section shall not be deemed <br />46 to prevent: <br />47 1.
