Chairperson Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION/t06-04-113 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT 110758 RELATING TO CINGULAR <br />WIRELESS' REQUEST FOR A VARIANCE TO MINIMUM LOT SIZE <br />REQUIREMENTS FOR A COMMUNICATIONS TOWER IN THE TOWER OVERLAY <br />DISTRICT <br /> <br /> WHEREAS, Cingular Wireless, hereinafter referred to as "Applicant", properly applied <br />for a Board of Adjustment variance from Section 9.15.03 (Towers in Residential Zoning <br />Districts) of the Ramsey City Code to construct a communications tower on a parcel less than ten <br />(10) acres in size that is generally known as 6405 Green Valley Road and legally described as: <br /> <br />Lot 4, Block 1, Valley View Estates, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br /> NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.07 of the Ramsey City Code on April 6, 2006, and that said public hearing was <br />properly advertised and that the minutes of said public hearing are hereby incorporated as a <br />part of these findings by reference. <br /> <br />2. That the Subject Property is zoned R-1 Residential (Rural Preserve). <br /> <br />3. That the parcels to the west and north are also zoned R-1 Residential (Rural Preserve) and the <br /> parcels to the east and south are zoned R-1 Residential (Rural Developing). <br /> <br />4. That the minimum lot size in the Rural Preserve District is ten (10) acres. <br /> <br />5. That Section 9.15.03 of the Ramsey City Code restricts the location of communications <br /> towers to parcels within the Tower Overlay District that are ten (10) acres in size or greater. <br /> <br />6. That the Subject Property is located within the Tower Overlay District. <br /> <br />7. That the Subject Property is approximately 9.27 acres. <br /> <br />That the Subject Property was approved as part of the Valley View Estates Plat in 2000, <br />which created four (4) new lots, each of which were substandard with regard to the ten (10) <br />acre minimum size requirement. <br /> <br /> <br />
