Record ID 1679144 <br /> <br />487311.002 <br /> <br />Councilmember Cook introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION # 05-05-149 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO <br />JAMES AND CHERI WALLER TO EXCEED THE MAXIMUM SQUARE FOOTAGE <br />ALLOWED FOR ACCESSORY BUILDINGS BASED ON FINDINGS OF FACT #0721 AND <br />DECLARING TERMS OF SAME: <br /> <br /> WHEREAS, James mad Cheri Waller (Permittees) have properly applied for a conditional <br />use permit to exceed the maximum square footage allowed for accessory buildings for properties <br />between 14,880 and 43,559 square feet as established in section 9.11.02 "Accessory Uses" of City <br />Code on the property generally known as 17937 Fluorine St NW and legally described as follows: <br /> <br />Lot 5, Block 7, Ford Brook Estates, Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br /> WHEREAS, the Planning Commission met on May 5, 2005, conducted the public <br />hearing and recommended City Council approval of the request; <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0721, a conditional use permit (Permit) to exceed the maximum <br />allowable square footage for accessory building space on properties between 14,880 and 43,559 <br />square feet in size, is hereby granted to James and Cheri Waller, hereinafter referred to as the <br />"Permittees". <br /> <br />That the overall square footage for accessory buildings may exceed the 1,488 square foot <br />accessory building size restriction for properties between the size of 14,880 and 43,559 square <br />feet by a total of 160 feet in order to accommodate the inside storage of private-use equipment <br />and vehicles. <br /> <br />3. That the maximum allowable height of the sidewalls is restricted to ten (10) feet and the overall <br /> mean gable height is restricted to sixteen (16) feet. <br /> <br />4. That the construction of the detached accessory building on the Subject Property shall require <br /> issuance of a building permit from the City of Ramsey. <br /> <br />5. That the accessory building shall be properly constructed and maintained in accordance with all <br /> applicable MN State Building Codes. <br /> <br /> <br />
