Presentation <br /> <br />Community Development Assistant Walther stated the City received an application from T.V. <br />Rao at 14359 Waco Street NW to regrade and stabilize the bluff line along the Rum River on his <br />property. The subject property is located in the Rum River Scenic Overlay District. Mr. Rao had <br />commenced work to stabilize and prevent further erosion of the river bank on his property, <br />unaware that a conditional use permit was required for this kind of project in the Overlay District. <br />Upon notification by City Staff of the need for a permit, work stopped and Mr. Rao submitted the <br />necessary applications, fees and plans. <br /> <br />Community Development Assistant Walther stated Mr. Rao indicated over the last 10 years his <br />property has lost eight feet of riverbank due to erosion. Mr. Rao is proposing to regrade the bluff <br />to a workable slope and stabilize it with the use of rip rap and native plants and grasses. <br /> <br />Community Development Assistant Walther indicated a letter was received from Matt and Karen <br />Casale in support of the conditional use permit. <br /> <br />Citizen Input <br /> <br />None. <br /> <br />Motion by Commissioner Jensen, seconded by Commissioner Nixt, to close the public hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Commissioners Jensen, Nixt, Dempsey, <br />Johnson, and Kociscak. Voting No: None. Absent: Commissioner Wivoda. <br /> <br />The public hearing closed at 7:43 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Anderson called the regular meeting of the Planning Commission back to order at <br />7:43 p.m. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Jensen, to recommend that City <br />Council adopt Findings of Fact in the affirmative relating to the application from T.V. Rao for a <br />conditional use permit for landscape alterations in the Rum River Scenic River Overlay District. <br /> <br />Further Discussion: Chairperson Anderson inquired if Mr. Rao would need further approval. <br />Community Development Director Sherman stated DNR approval was required. She indicated <br />Staff would verify whether the Corps of Engineers approval is required. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Commissioners Johnson, Jensen, Dempsey, <br />Kociscak, and Nixt. Voting No: None.
