Zoning Administrator Frolik explained it is the City's policy to require drainage improvements to
be platted as drainage easements on the nearest platted lot and that outlots identify property
eligible for future development. Because the existing detention pond on the property serves both
the hotel and Lot 2, the developer is attempting to avoid placing a tax burden for perpetuity on
the owner of Lot 2 by platting the ponding area as a separate outlot. In order to maintain City's
policies, Staff recommends that the detention pond be incorporated into Lot 2 as a drainage
easement,

Zoning Administrator Frolik said the current property plat has a right-in only from eastbound
Highway 10, an access on Sunfish Lake Boulevard and another on Riverdale Drive. The
Developer's intent is to continue use of this traffic pattern to serve both Lots 1 and 2 after the
property split via the use of driveway easements. Park dedication requirements were satisfied
when the property was platted as Lot 1, Block 1, Riverview Estates; no additional park dedication
is due with this replat.

Zoning Administrator Frolik indicated discussing sewer trunk charges with the Grosslein's. Alter
reviewing City records, staff found that sewer trunk charges of 4 acres had already been paid.
Staff is recommending sewer and water trunk charges for. 5 acres, which could be deferred until
site plan approval is received for the building.

Motion by Commissioner Johnson, seconded by Commissioner Wivoda, to approve the sketch
plan for G-B Properties First Addition and recommend that City Council grant final plat approval
contingent upon adding Outlot A onto Lot 2 as an easement.

Motion Carried. Voting Yes: Chairperson Anderson, Commissioners Johnson, Wivoda,
Dempsey, Jensen, Kociscak, and Nixt. Voting No: None.

Case #4:

Request for a Conditional Use Permit to Exceed the Total Accessory
Structure Space and the Maximum Single Accessory Structure Size
Restrictions; Case of Francis and Teresa Moulzolf

Zoning Administrator Frolik stated the application from Francis and Teresa Moulzolf is for a
conditional use permit to exceed the total accessory structure/garage space allowed and the
maximum single accessory structure size restrictions on their property at 14260 Junkite Street
NW. The addition of the proposed 1,152 square foot accessory building will increase the total
garage space on the property to 1,752 square feet, which is an 88 square foot overage. It also
represents a 352 square foot overage in the size restriction for any single accessory structure. She
indicated the City has approved several overages in accessory buildings in this range over the past
two years.

Motion by Commissioner Wivoda, seconded by Commissioner Dempsey, to accept Findings of
Fact #1 - 10 as presented.

Motion Carried. Voting Yes: Chairperson Anderson, Commissioners Wivoda, Dempsey, Jensen,
Johnson, Kociscak, and Nixt. Voting No: None.

Planning Commission/January 5, 1999
