Case #2

REQUEST FOR

By: Mark

SKETCH PLAN REVIEW OF HAUSER ADDITION;
CASE OF HAUSER PROPERTIES
S. Banwart, Community Development Director

Background:

The proposed minor subdivision on platted land has an area of 4.3 acres and will consist of three
(3) rural business lots. The individual lots will have an area of 1/2 acre, 1.28 acres and 2.52 acres.
The existing zoning is B-I Business District. The legal description of the property is Lot 3, Block
1 Hy-10 Ramsey Addition. The P.I.N. is 29-32-25-14-0007. For your information, the
following items are enclosed:

A)
B)
C)
D)
E)
F)

Site location map
Proposed subdivision (A)
City Landscape Architect's Review (December 26, 1989)
City Engineer's Review (December 27, 1989)
Proposed Subdivision (B) as modified with one acre minimum lots
City Engineer's Review (February 27, 1990)

Observations:

On December 12, 1989, the City of Ramsey received an application and sketch plan from Hauser
Properties for Hauser Addition.

On October 25, 1988, the Ramsey City Council adopted Ordinance #88-18 rezoning Lot 3, Block
1, HY-10 Ramsey Addition from I-1 Industrial to B-1 Business. The minimum lot area in a B-I
Business District is 1/2 acre. However, the intent of B-1 Business is to serve urban areas and
unfortunately, this rezoning should have been zoned RB Rural Business District. This is because
the intent of an RB Rural Business District is to permit certain restricted business uses in areas
outside the City's urban sewer service area. The minimum lot area in a RB Rural Business District
is 1 acre.

On January 2, 1990, the Ramsey Planning and Zoning Commission tabled the sketch plan review
of Hauser Addition to allow all of the parties involved more time to explore all issues and options
in more detail.

Chairman Zimmerman stated that the City does not want to set a precedent of allowing one half
acre lots in the Rural Business area and there are other options available in this particular situation
that would be much more beneficial to the property owner and developers of the liquor store.

On January 11, 1990, the Ramsey Park and Recreation Commission consensus was to satisfy park
dedication requirements in cash in the amount of 5% of the fair market value for each new lot
created (Lots 1 and 2) - (This is in accordance with Ramsey City Ordinance #89-17). Further
investigation indicates that park dedication has not been paid for Lot 3, Brook's Superette. Thus,
these fees should also be collected unless the owner of said property can prove payment of these
fees.

Based on 1990 valuation, the property was worth Thirty-two Thousand Three Hundred Dollars
($32,300.00). Five percent of the value would be One Thousand Six Hundred Fifteen Dollars
($1,615.00).
