The applicant is requesting that the monitoring program ~e modified <br />to eliminate testing for those pollutants unlikely to be found in <br />more than trace amounts. In addition, MPCA requires an emissions <br />test only once every five years rather than the CUP's requirement <br />of one each year. <br /> <br />The following information is enclosed for your information: <br /> <br />a) <br /> <br />b) <br /> <br />d) <br />e) <br />f) <br />g) <br />n) <br />±) <br /> <br />Application and supplemented information of 9/7/90 and 9/19/90 <br />letter. <br />Site location map. <br />Description of operations. <br />Public hearing notice. <br />Properties notified. <br />Existing CUP. <br />Incident reports and subsequent correspondence. <br />Proposed findings of fact. <br />A copy of the proposed conditional use permit will be <br />available at your meeting. <br /> <br />Observations: <br /> <br />The applicant has since acquired Lots 2 and 3 immediately north of <br />the existing parcel and has been storing buses on the property <br />which are later dismantled and used as feedstock for his operation. <br />The storage is currently not covered by the existing CUP and does <br />not conform to City requirements for exterior storage. <br /> <br />In 1989, there were six police incident reports related to <br />excessive smoke emissions or open burning. In December, staff met <br />with Mr. Karst to discuss and try to remedy the problem. Since <br />that time one incident report has been filed and one complaint was <br />received (4/26 and 4/28). Copies of the incidents and <br />correspondence are attached. <br /> <br />The buildings electrical wiring is not up to code and has been a <br />source of concern for the state electrical inspector. The city <br />building inspector has indicated that in a September 27 discussion <br />with the state electrical inspector, that action i~ still pending. <br /> <br />Mr. Karst is requesting that a new CUP be issued (or the existing <br />modified) to allow for the operation of a second furnace and to <br />modify the emissions testing requirements. <br /> <br />Staff Recommendation: <br /> <br />A new CUP should be issued or the existing one modified which <br />addresses the following: <br /> <br />- Yearly emissions testing until such time that complaints or <br /> incident reports are fewer than one/year on average. <br /> <br /> <br />
