CASE # 3 <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A COMPOUND TYPE <br />FACILITY TO INCLUDE A COMMERCIAL DOG KENNEL AND MORE THAN <br />ONE RESIDENTIAL STRUCTURE ON A LOT OF RECORD; CASE OF <br />CHARLES DELANEY <br /> By: Sylvia Frolik, Zoning Administrator <br /> <br />Background: <br /> <br />I am sure that you are all familiar with the well-known establishment in Ramsey known as the <br />Armstrong Ranch Kennels. The facility is located on 161st Avenue, west of Armstrong Blvd. and <br />consists of a total of 80 acres. The property was fkst settled by Fred Armstrong where he began a <br />commercial dog kennel operation in 1926. Since that time, the kennels have expanded and the <br />facility continues to be a family owned business now operated by Charles and Lorel I. Delaney and <br />their daughter. Currently there exists on the site the original Armstrong homestead which now <br />serves as a summer cabin, the home of Charles and Lorel I. Delaney and the home of their <br />daughter. The addition of residences on the property was not facilitated through any subdivision <br />of the property and in researching the property file, I can find no evidence of building permits <br />being issued. How it came to be that there are now, technically, 3 residential structures on one lot <br />of record is a mystery. <br /> <br />The Delaneys are now proposing to construct a new home on the property for their daughter and <br />convert the daughter's existing home into living quarters for seasonal employees of the kennel <br />operation. When informed that City Code restricts the number of main buildings to one per lot of <br />record, the Delaneys expressed a desire to not subdivide the property and apply for a conditional <br />use permit to accommodate their unique use. At the same time, it was brought to the attention of <br />City Staff that the kennel operation, which is defined as a pre-existing non-conforming use, has <br />been expanding over the years, even as recent as 1989. The expansion of a non-conforming use <br />does require application for a conditional use permit. City Staff then determined that it would be in <br />the best interest of Charles and Lorel I. to sanction the commercial kennel operation on the site in <br />conjunction with the conditional use permit to have more than one residential structure on a lot of <br />record. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Site plan <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Observations: <br /> <br />On October 19, 1990, the City of Ramsey received an application from Charles Delaney for a <br />conditional use permit to have more than one residential structure on a lot of record and to operate a <br />commercial dog kennel in the R-1 Rural Residential District. <br /> <br />On November 7, 1990, the Ramsey Planning and Zoning Commission conducted a public hearing <br />regarding Mr. Delaney's request for a conditional use permit. <br /> <br /> <br />
