CASE # 4 <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A HOME OCCUPATION <br />TO OPERATE A RETAIL TROPHY/PLAQUE BUSINESS IN THE R-1 URBAN <br />RESIDENTIAL DISTRICT; CASE OF STEVEN HAIGH <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Mr. Steven Haigh is requesting a conditional use permit to operate a retail trophy/plaque business <br />in his home at 14151 Germanium Street N.W. Retail activity is not a permitted use in the R-1 <br />Urban Residential District. <br /> <br />The Ramsey City Code states that conditional use permits may be issued for home occupations <br />provided the proposed use is limited to one room of the home that does not total more than 20% of <br />the total floor area in the home. Mr. Haigh is proposing to conduct the business in the lower level <br />of his home in a room approximately 288 square feet in size, which is less than 20% of the total <br />floor area in the home (2,556 square feet). <br /> <br />The City Code also states that merchandise shall not be displayed or offered for sale either within <br />or outside of the residence, and that the operation of any wholesale or retail business, unless it is <br />conducted entirely by mail, and does not involve the sale, shipment or delivery of merchandise on <br />the premises, is prohibited. Mr. Haigh is proposing to display merchandise within the residence <br />and the retail activity will involve the sale and delivery of merchandise on the premises. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Application proposal and site plan <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />It should also be noted at this time that conditional use permits for home occupations are temporary <br />in nature and granted to a designated person who resides at the address; they are not transferrable <br />from person to person or from address to address. <br /> <br />In researching City records, it has been determined that since 1981, the Ramsey City Council has <br />denied 5 similar requests which involved retail activity in residential zones. <br /> <br />Observations: <br /> <br />On October 9, 1990, the City of Ramsey received an application from Steven Haigh for a <br />conditional use permit for a home occupation at 14151 Germanium Street N.W. <br /> <br />A public hearing by the Planning and Zoning Commission was advertised for Wednesday, <br />November 7, 1990. <br /> <br /> <br />
