Application for CUP <br />Aluminum Recycling, Inc. <br />by: Merland Otto <br /> <br />Background: <br /> <br />The Planning and Zoning Commission held a public hearing on <br />November 20, 1990 and acted on findings of fact and a CUP. The <br />case was tabled until December 6, 1990 for final action pending the <br />City Attorney's review to determine whether the proposed facility <br />was a solid waste management facility under Ordinance 90-5 and any <br />review comments he might have on the conditions of the CUP. <br /> <br />The central point of discussion is whether the drop off/recycling <br />operation accepts "waste" or whether recyclable materials in an <br />unprocessed state are not waste. It is the Staff's opinion that <br />recyclable materials are waste unless the material is being <br />processed with a resulting end product being produced on the site. <br />The attachments would seem to support this concept. In particular, <br />from the KAB recycling manual, in the section on Paper Recycling <br />it states, "Keep in mind that collection is only the first step in <br />recycling. Recycling takes place when waste paper is used as a raw <br />material to make a new product and during that process the waste <br />paper loses its identity." <br /> <br />The Minnesota Waste Management Act (115.A.02) specifically mentions <br />separation and recovery of materials, waste recycling as waste <br />manaqement practices. (underlining added (see attachments). <br /> <br />Also attached are definitions from MPCA rules 7035.0300. You'll <br />note that the solid waste definition of Ordinance 90-5 is the same <br />as that of 7035.0300 subp. 100. You will further find "waste" <br />defined in Subp. 112 referencing MS 115A.03 Subd. 34. <br /> <br />The Anoka Co.
