PRINTER'S AFFIDAVIT OF PUBLICATION <br /> <br />ORDINANCE NO. 98-08 <br />CITY OF RAMSEY <br /> <br /> ANORA COUNTY · <br /> STAT[ OF MINNESOTA -' ' "' <br />AN INTERIM ORDINANCE ESTABLISHING A MORATORIUM ON THE DEVELOPMENT OF <br />CERTAIN PARCELS OF LAND WITHIN THE CITY OF RAMSEY, ANOKA COUNTY, MINNESOTA <br />The City of Ramsey Ordains: <br />SECTION 1. AUTHORITY .. <br /> This Ordinance is adopted pursuant to that authority granted to the City by MSA 462.355, <br />Subd. 4, entitled "Interim Ordinance." <br />SECTION 2. PREAMBLE AND PURPOSE ' <br /> WltEREAS, the City Council has eng~iged a planning consultant to update the City's <br />Comprehensive Plan; and <br />WHEREAS, part of the consultant's efforts include the creation of a land use map; and <br />WHEREAS, based on the studies to date; the City Council has determined that there are <br />certain parcels within the City that are land 'use sensitive and subject to change in the compre- <br />hensive plan amendment; and <br /> WHEREAS, the City Council finds that an interim ordinance placing a moratorium on the <br />development of certain parcels is necessary to protect the planning process and the health, safety <br />and welfare of the citizens of R?msey. <br />SECTION 3. PROHIBITION <br /> During the term of this Ordinance, notwithstanding Chapter 9 of the City Code, 'entitled <br />"Zoning and Subdivision of Land," no subdivision, rezoning, site plan approvals, conditional use <br />permits or variances of any kind shall be permitted and no applications for said subdivision, <br />rezoning, site plan approval, conditional use permit or variance shall be accepted on the parcels <br /> <br />) ss <br /> <br />identified as follows: <br />27-32-25-22-0006 27-32-25-22-0003 <br />34-32-25-22-0012 34-32-25~24-0037 <br />34-32-25.23~0007 34-32-25 ~24-0040 <br />24-32-25-23-0001 24-32-25-2~-0003 <br />24-32-25 -32-0064 25-32-25 -22-0004 <br />36-32-25-21-0003 34-32-25-14-0014 <br />2S-32-2S-32-0001 25-32-25;31-0009 <br />SECTION 4. UNDUE HARDSHIP EXCEPTIONS <br /> <br /> 27-32-25-22-0002 <br /> 34-32-25-23-0005 <br /> 23-32-25-14-0001 <br /> 24-32-25-23-0002 <br /> <br />' 25-32-25-21-0010 <br /> 34-32-25-14-0016 <br /> 25-32-25-31,0008 <br /> <br /> The City Council may grant an exception to the provisions of this Ordinance when, in its opin- <br />ion, undue hardship may result from strict compliance. In granting an exception, the City Council <br />shall prescribe any conditions that it deems necessary to or desirable for .the protection of the <br />public interest. NO exception shall be granted unless the City Council finds: <br />1. That there are special circumstances or conditions affecting said property such that the strict <br /> application of the provisions of this Moratorium Ordinance Would deprive:the petitioner of <br /> the reasonable use of petitioner's land. .: <br /> <br />2. That the exception is necessary for the preservation and enjoyment of a substantial property <br /> right of tile petitioner. ': <br />3. That the granting of the exception will not be detrimental to the public welfare, or injurious to <br /> other property in the area in which the property is situated. <br />4. That the proposed exception will be harmonious with and,!n accordance with the specific <br /> objectives of the City's existing Comprehensive Plan and will not adversely affect the planning <br /> process for adoption of amendments to the Comprehensive Plan above described. <br />5. That the proposed use/subdivision will be consistent with the intent and purpose of this <br /> Ordinance. <br />SECTION 5. TERM . <br /> The term of this Ordinance shall be for a period of six months commencing with its effective <br />date. The term may be extended after approval by the City Council for an additional period not <br />~:xceeding 24 months, as provided for in Minnesota Statutes, Section 462.355, Subd.,4. <br />SECTION 6. PENALTIES <br /> Any person, firm, entity or corporation that undertakes any development activity in violation <br />of the provisions of this Ordinance shall be guilty of a misdemeanor and shall be subject to any <br />additional legal or equitable remedies available to the City. <br />SECTION 7. EFFECTIVE DATE..
