<br /> AN INTERIM ORDINANCE ESTABLISHING A MORATORIUM ON THE DEVELOPMENT OF
<br /> CERTAIN PARCELS OF LAND WITHIN THE CITY OF RAMSEY, ANOKA COUNTY, MINNESOTA
<br /> The City of Ramsey Ordains:
<br />SECTION 1. AUTHORITY ,
<br /> This Ordinance is adopted pursuant to that authority granted to the City by MSA 462.355,
<br />Subd. 4, entitled "Interim Ordinance."
<br />SECTION 2. PREAMBLE AND PURPOSE
<br /> WHEREAS, the City Council has engaged a planning consultant to update the City's
<br />Comprehensive Plan; and
<br />WHEREAS, part of the consultant's efforts include the creation of a land use m;~p; and
<br />WHEREAS, based on the studies to date, the City Council has determined that-there are
<br />certain parcels within the City that are land use sensitive and subject to change in the compre-
<br />hensive plan amendment; and
<br /> WHEREAS, the City Council finds that an interim ordinance placing a moratorium on the
<br />development of certain parcels is necessary to protect the planning process and the health, safety
<br />

<br />SECTION 4. UNDUE HARDSHIP EXCEPTIONS ·
<br /> The City Council may grant an exception to the provisions of this Ordinance when, in its
<br />opinion, undue hardship may result from strict compliance. In granting an exception, the City
<br />Council shall prescribe any conditions that it deems necessary to or desirable for the protection of
<br />the public interest. NO exception shall be granted unless the City Council finds:
<br />1. That there are special circumstances or conditions affecting said property such that the strict
<br /> application of the provisions of this Moratorium Ordinance would d6prive the petitioner of
<br /> the reasonable use of petitioner's land. .
<br />2. That the exception is necessary for the preservation and enjoyment of a substantial property
<br /> right of the petitioner.
<br />3. That the granting of the exception will not be detrimental to the public welfare or injurious to
<br /> other property in the area in which the property is situated.
<br />4. That the proposed exception will be harmonious with and in accordance with the specific
<br /> objectives of the City% existing Comprehensive Plan and will not adversely affect the planning
<br /> process for adoption of amendments to the Comprehensive 'Plan above described.
<br />5. That the proposed use/subdivision will be consistent with the intent and purpose of this
<br /> Ordinance.
<br />SECTION 5. TERM /
<br /> The term of this Ordinance shall be for a period of six months commencing with its effective
<br />date. The term may be extended after approval by the City Council for an additional period not
<br />.exceeding 24 months, as provided for in Minnesota Statutes, Section 462.355, Subd. 4.
<br />SECTION 6. PENALTIES
<br /> Any person, firm, entity or corporation that undertakes any development ac~tivity in violation
<br />of the provisions of this Ordinance shall be guilty of a misdemeanor and shall be subject to any
<br />additional legal or equitable remedies available to the City.
<br />SECTION 7. EFFECTIVE DATEr
<br /> This Ordinance shall take effeCt upon adoption and thirty (30) days after publication accord-
<br />ing to law, subject to Charter Provision, Section 5.04. .
