<br /> CERTAIN PARCELS OF LAND WITHIN THE CITY OF RAMSEY, ANOKA COUNTY, MINNESOTA
<br /> The City of Ramsey Ordains~
<br /> SECTION 1. AUTHORITY
<br /> This Ordinance is ad6pted pursuant to that.authority granted to the City by MSA 462.355,
<br />· Subd. 4, entitled "Interim Ordinance."
<br /> SECTION 2. PREAMBLE AND PURPOSE
<br /> WHEREAS, tl~e City Council has engaged a planning c~nsultant' to update the City's·
<br /> Comprehensive Plan; and
<br /> WHEREAS, part of the consultant's efforts include the creation of a land use map; and
<br /> WHEREAS, based on the studies to date, the City Council has determined that there are certain
<br /> parcels within the City that are land use sensitive and subject to change in.the comprehensive plan
<br /> amendment; and
<br /> WHEREAS, the City Council finds that a new ordinande extending a moratorium on the devel-
<br /> opment of certain parcels is necessary to protect the planning process which is currently under
<br /> way, and to protect the health,- safety and welfare of the citizens of Ramsey, and to provide the
<br /> ~ity with an opportunity to f~dopt official controls to implement the new comprehensive plan.
<br /> SECTION ~,. PROHI~,ITION
<br /> During the te~m of this Ordinance, notwithstanding Chapter 9 of the City Code, entitled
<br />· "Zoning and Subdivision of Land," no subdivision, rezoning, site plan approvals, conditional use
<br /> permits or variances of any kind shall be permitted and no applications for said subdivision,
<br /> rezonJng, site plan approval, conditional use permit or variance shall be accepted until after the
<br /> specified dates on the parcels identified as follows:

<br /> SECTION 4. UNDUE HARDSHIP EXCEPTIONS
<br /> The City Council may grant an exception to-the, provisions of this Ordinance when, in its
<br />opinion, undue hardship may resuit from strict compliance, in granting an exception, the City
<br />Council shall prescribe any conditions that it deems necessary to or. desirable for the protection of
<br />the public interest. NO exception shall be granted unless the City Council finds:
<br />1. That there are special circumstances or conditions affecting said property such that the strict
<br /> applicat on of the provisions of this Moratorium Ordinance, would deprive the petitioner of
<br /> the reasonable use of petitioner's land.
<br />2. That the exception is necessa.ry for th? preservation and enjoyment of a substantial property
<br /> ri'ght of the petitioner.
<br />3. That the granting of the exception will not be detrimental to the public welfare or injurious to
<br /> other property in the area in which the property is situated.
<br />4. Tha_t the proposed exception will be harmonious with and in accordance with the specific
<br /> objectives of the City's existing Comprehensive Plan and will not adversely affect the planning
<br /> pro~:ess for adoption of amendments to the Comprehensive Plan above described.
<br />5. That'the proposed use/subdivision will be consistent with the intent and purpose of this
<br /> Ordinance.
<br /> 5. TERM
<br /> The term of this Ordinance shall be as specified in Section 3 herein.'
<br /> 6. PENALTIES ,
<br /> Any person, fi~m, entity or corporation that undertake~ any developmen~ activity in violation
<br /> of the provisions of'this Ordinance shall be g.uilty of a misdemeanor and 'shall be subject to a~y
<br /> additional'legal or equitable remedies available to the City.
<br /> SECTION 7. EFFECTIVE DATE.
<br /> This Ordinapce shall take effect upon adoption and thirty (30) days after publication accord-
<br /> ing to law, subject to Charter Provision, Section S.0.4.
