application and such hearings shall be held at such time and upon such notice as the Council may determine. SECTION 5. CONDITIONS The Council may impose any conditions or restrictions it deems necessary or advisable to protect the public health, safety, and welfare, including but not limited to conditions relating to the hours of operations, the lighting of the premises and the parking facilities. The Council may impose any conditions or restrictions at any time after the issuance of a license hereunder. A bond may be required in such form and amount as specified by the Council to guarantee compliance with any conditions that shall be herein imposed. The license shall permit operation of the circus or carnival only on the days specified in the application. SECTION 6. LICENSE FEES A non-refundable application fee shall be established by Council resolution and shall be paid at the time the application is submitted to the City. The fee for the license shall be established by Council resolution and the fee shall be paid at the time the license is issued. SECTION 7. INSURANCE mo The Licensee shall obtain and keep in full force and effect proper liability insurance coverage to protect the City and said Licensee against any claims or liability for personal injury or property damage sustained by any persons as a result of the operation of said circus or carnival. The liability insurance coverage shall name the City as an additional insured, and said insurance coverage shall have minimum limits of liability with respect to bodily injury of one hundred thousand dollars ($100,000.00) for each person and three hundred thousand dollars ($300,000.00) for each occurrence and fifty thousand dollars ($50,000.00) with respect to property damage. Bo Said Licensee shall obtain and keep in full force and effect proper insurance coverage against any liability for injury sustained by any persons operating said license activities as required under the provisions of the Workers' Compensation Act of the State. C. Said Licensee shall submit to the City Clerk satisfactory certificates of insurance for the coverage required herein prior to issuance of an approved license. SECTION 8. INDEMNIFICATION The Licensee shall, indemnify, defend, and hold harmless the City from any claims and any liability in whatsoever manner arising, which may be brought against the municipality, as the result of the operation of the carnival. Indemnification shall be provided to the City in writing prior to issuance of an approved license.
