<br /> whose remora is"sought, the grounds for
<br /> recall, which. 'sha be malfeasance, misfea-
<br /> sance, or nonfeasance in office, .in not more
<br /> than 2.50 words, and~the intention of the spun-
<br /> soring committee-to bring about the officer's
<br /> recall. Such petitiori shall be filed in the C_Lt~

<br /> lation. If the petition or amended petition is
<br /> found, sufficient under the prowsions of sec-
<br /> tion 5.3. of this chapter, the ci~ (clerk

<br /> · sought to be recalled of the sufficiency df the
<br /> ~etition and of the. pending actio~. The coun-

<br /> ADMINISTRATI ON OF CITY AFl'AIRS
<br /> Section 6.1. Ad mlnistrati~te
<br /> Responsibility.
<br /> '-The cou ~cil~ as a body, shall be responsible
<br /> for the administration o~ the city. The council.
<br /> shall~appoint an administrative office~ to assist
<br /> inthe administration-of city affairs. For purp~s;:

<br /> Section' 6.3; Duties 'of the City
<br />
<br /> · /The: ci~ (c-4~k. administt-ator) shall be the
<br /> i:hiEf'administsative officer for the counc~il. The
<br /> council shall establish by resolution, the pow-
<br /> ers, duties and reporting requirements of the
<br /> ~ ( ...... adm nistrator)
<br /> Section 6.4. Purchases ahd Contract.
<br /> All-pLi~:chases shaJ be made and all con-
<br />tracts let by the'council. Contracts sba be
<br />made i~ compliance with-the uniform contact-
<br />ing law, and whenever competitive bids are
<br />required, the contract shall be let to thelowest
<br />responsible bidder. All .contracts, bonds and.~
<br />'instrUments of a~y kind to which the city is
<br />party shall be signed by the mayor and the
<br />ci~ (c-4er. k administrator) on behalf of the city
<br />and shall be executed'th the name of the ci~.
<br />The counc!l mayby ordiriance adopt further
<br />regulations for the making of bids and the let-
<br />ting of contracts. .
<br />Section 6.$. Subordinate Officers.
<br />There shall' be a city clerk and such other
<br />officers subordinate to the city administrator
<br />as the ci_ty council may create by ordinance.
<br />_The city clerk, subject to the direction of tho
<br />~itv administrat.oL shall keeb the pubJic
<br />rec';~rds, and shall have other duties as the city
<br />administrator shall prescribe. In addition, tho
<br />dry clerk shall have other powers and duti~
<br />imposed by state law, this charter, city ordi
<br />nance and ciW resolution. The Council may by
<br />

<br /> recommendations in' accordance with a bud-

<br /> ensuing fiscal y~ar and, except as required by.
<br /> state statutes or this charter, shall be i'n such
<br /> 'fd~fi as the c~un;-il may. require, t shall
<br /> include a summary and show in detail all'esti-
<br /> mated income and' ali proposed-expenditures,.
<br /> including debt service and comparative figures
<br /> for the current fiscal'year, actual and estimat-
<br /> ed, and the preceding year. In -addition 'to
<br /> showing proposed expendKures for current.
<br /> operations, it shall.'show proposed capital
<br /> expenditures to be m~de during the year. and
<br /> the proposed methpd of financing each such
<br /> capital expenditure. The total prdposed oper- '
<br /> ating budget to be provi_ded from the property
<br /> tax shall not exceed' the amounts authorized~
<br /> by state statutes and this charter. Consistent
<br /> with these provisions, the budget, shall contain
<br /> such information and be in the form pre-
<br /> scribed by ordinance and by state statutes. The
<br /> Annual Financial Statement shall be in such
<br /> form as state statutes,, this charter or the couh-
<br /> - oil may pres~:ribe.
<br /> . 7.6;1. The budget public hearing dates;
<br /> procedures to b~ followed during the .hear-
<br /> 'ngs, and publications are established by state
<br /> statute. However, the actual adoption of the
<br /> proposed annual'budget and the municipal
<br /> levy shall take place at the .next regularly
<br /> scheduled council meeting following th~ man-
<br /> dated' public hearing(s) to ensure.that com-
<br /> ments received 'during the~ public-hearidg(s)
<br /> are given due consideration before the ,final
<br /> budget and-municipal tax levy are adopted.
<br /> The council, may revise the'proposed budget
<br /> but no amendment to !the budget shall
<br /> increase the authorized expenditures to an
<br /> amount greater than the estimated funds, avail-
<br /> able; The council shall adopt the-budget by a
<br /> resolutio~ that shall set forth the total for each
<br /> budgeted fund and each oep~rtment, function
<br /> or program, with such segregation as. to
<br /> objects and purpose of expenditu[es as the
<br /> council deems necessary for purposes of bud-
<br /> get control. The counci! shall a ~so adopt a reso-
<br /> luUon levying the amount of taxes provided, in
<br /> the budget, and:the ~ (ci~/administrator),
<br /> shall certify the tax resolution to the county
<br /> auditor in accordance with state law. Adoption
<br /> of. the budget resolution shall constitute
<br /> appropriations at the beginning of the fisca
<br /> year of the sums fixed in the resolutio, of the
<br /> several, purposes named:

<br /> Section 10.1. Except ~s-'otherwise provided '
<br /> by state statu_tes, no person, form or (torpora-
<br /> tion sl~all place or maintain any permanent:or
<br /> semi,permanent fixtures'in~ over, upon or.
<br /> under, any street 'or~ public place for the pur-
<br /> pose of operating a public utility, or for any
<br /> other' purpose, without a franchise therefore
<br /> from the city. A franchise shall be. granted o.nly
<br /> by ordinance, which shall..not be anemer-
<br /> gency ordinance. No.exclusive franchise shalJ
<br />· be granted unless the proposed ordinanCe-is
<br />submitted m the voters, of the.city following;a.
<br />public headng and approved'by at. least a
<br />majority df those voting thereon: I~very ordi-
<br />nance granting a franchise shall contain .all the
<br />term~ and conditions of the franchise. The
<br />grantee shall bear the costs of publication of'
<br />the franchise ordinance and ~hall make a suffi-
<br />cient deposit'with the c_Ll:y_(clerk =d.m.!~.~t::t~r)
<br />to guarantee publication before the ordinance
<br />is passed.

<br /> MISCELLANEOUS AND TRANSITORY .
<br /> PROVISIONS '.
<br />Section 12.2. Oath of Office
<br /> Every officer of the city shall, before enter- ·
<br />lng. upon the duties of his/her office, take and
<br />subscribe an oath of office in substantially the
<br />following form: '1 do solemnly swear (or
<br />affix:) to support the constitution of the United
<br />States and of this state and to discharge faith-
<br />fully the ~Juties devolving upon me as (mayor,
<br />
<br /> councilmember, ~y_(~k administratoi), etc.)
<br /> of the City of Ramsey to the best of my judg-
<br /> ment aha ability",
<br /> Section 12.4. Official Bonds. ' ,
<br /> The ~ (c-lerda adminisU:ator) and other
<br /> s'uch officers or employees of the city as may
<br /> be nrovided for by ordinance'shall each,
<br />· before enterin, g .upon the duties of his/her
<br /> respective 'dffice or employ~ment, give a cor~'o-
<br /> rate. sui'ety bond to the city in such form and
<br /> such amount,as maybe fixed, by the'council as
<br /> seci~rify for ~e faithful performance of his/her
<br /> official dutieS. This corporate surety bond may
<br /> be in the form of either.individual or blanket
<br /> Ponds at the discretion of'the ~ouncil. They
<br /> shall be approved by the council, and
<br /> ' ,approved ~s to: form by the city. attorney, 'and
<br />· fil~d with the ~.(c4e~ adminisl~rator). The.
