relocated by the City at the cost of the Grantee. The City shall not be liable to the <br />Grantee for damages resulting from such removal, alteration or relocation. <br /> <br />SECTION 4. <br /> <br />DESIGN PROVISIONS <br /> <br />4.1 System Facilities and Equipment. <br /> <br />4.1.1 Upon completion of the System Upgrade, the System generally shall have at least <br /> the following characteristics: <br /> <br />4.1.1.1 <br /> <br />a modem design when built, utilizing an architecture that will <br />permit additional improvements necessary for high-quality and <br />reliable service throughout the Franchise term, and the capability <br />to operate continuously on a twenty-four hour a day basis without <br />severe material degradation during operating conditions typical to <br />the Minneapolis/St. Paul metropolitan area; <br /> <br />4.1.1.2 <br /> <br />standby power generating capacity at the headend. The Grantee <br />shall maintain motorized standby power generators capable of <br />powering all headend equipment for at least twenty-four (24) <br />hours. The back-up power supplies serving the System shall be <br />capable of providing power to the System for not less than three <br />(3) hours per occurrence measured on an annual basis according to <br />manufacturer specifications in the event of an electrical outage. <br />The Grantee shall maintain sufficient portable motorized <br />generators to be deployed in the event that the duration of a power <br />disruption is expected to exceed three (3) hours; <br /> <br />4.1.1.3 <br /> <br />facilities of good and durable quality, generally used in high- <br />quality, reliable systems of similar design; <br /> <br />4.1.1.4 <br /> <br />a System that conforms to or exceeds all applicable FCC technical <br />performance standards, as amended from time to time, which <br />standards are incorporated herein by reference, and any other <br />applicable technical performance standards. End of the line <br />performance must meet or exceed FCC specifications at the end of <br />the Subscriber Drop; <br /> <br />4.1.1.5 <br /> <br />a System shall, at all times, comply with applicable federal, State <br />and local rules, regulations, practices and guidelines pertaining to <br />the construction, upgrade, operation, extension and maintenance of <br />Cable Systems, including, by way of example (but not limitation): <br /> <br />(A) National Electrical Code, as amended from time to time; and <br /> <br />16 <br /> <br /> <br />
