may by an appropriate selector, permit a Subscriber to view all signals of a particular <br />service. <br /> <br />1.15 <br /> <br />"CPI" means the annual average of the Consumer Price Index for all Urban Consumers <br />(CPI-U) for the Minneapolis-St. Paul CMSA, as published by the Bureau of Labor <br />Statistics. <br /> <br />1.16 <br /> <br />"Drop" means the cable that connects the ground block on the Subscriber's residence or <br />institution to the nearest feeder cable of the System. <br /> <br />1.17 <br /> <br />"Educational Access Channel" or "Educational Channel" means any 6 MHz channel on <br />the System set aside by the Grantee, the Commission and/or the City for Noncommercial <br />educational use by educational institutions, as contemplated by applicable law. <br /> <br />1.18 <br /> <br />"FCC" means the Federal Communications Commission, its designee, and any legally <br />appointed, designated or elected agent or successor. <br /> <br />1.19 <br /> <br />"Franchise" or "Cable Franchise" means this ordinance, as may be amended from time <br />to time, any exhibits attached hereto and made a part hereof, and the regulatory and <br />contractual relationship established hereby. <br /> <br />1.20 <br /> <br />"Governmental Access Channel" or "Governmental Channel" means any 6 MHz <br />channel on the System set aside by the Grantee, the Commission and/or the City for <br />Noncommercial use by the City or its delegatee. <br /> <br />1.21 <br /> <br />"Grantee" is MediaOne North Central Communications Corporation, d/b/a AT&T <br />Broadband, and its lawful successors, transferees or assignees. <br /> <br />1.22 <br /> <br />"Gross Revenues" means any and all revenues arising from or attributable to, or in any <br />way derived directly or indirectly by the Grantee or its Affiliates, subsidiaries, or parent, or <br />by any other entity that is a cable operator of the System, from the operation of the <br />Grantee's System to provide Cable Services (including cash, credits, property or other <br />consideration of any kind or nature). Gross Revenues include, by way of illustration and <br />not limitation, monthly fees charged to Subscribers for any basic, optional, premium, per- <br />channel, or per-program service, or other Cable Service including, without limitation, <br />Internet access and Cable Modem service fees charged to Subscribers, to the extent such <br />services are offered as a Cable Service under applicable law; Installation, disconnection, <br />reconnection, and change-in-service fees; Lockout Device fees; Leased Access Channel <br />fees; late fees and administrative fees; fees, payments or other consideration received from <br />programmers for carriage of programming on the System and accounted for as revenue <br />under GAAP; revenues from rentals or sales of Converters or other equipment; fees related <br />to commercial and institutional usage of the System or the I-Net; advertising revenues; <br />interest; barter; revenues from program guides; franchise fees; and revenues to the System <br />from home shopping, bank-at-home channels and other revenue sharing arrangements. <br />Gross Revenues shall include revenues received by an entity other than the Grantee, an <br />Affiliate or another entity that operates the System where necessary to prevent evasion or <br /> <br />4 <br /> <br /> <br />
