I'KINIEK'3 AI~I~ILIAVII Ul~ I'UBLIC:AIILIN ORDINANCE #01-10 CITY OF RAMSEY ANOKA COUNTY STATE OF MINNESOTA AN ORDINANCE TO AMEND SEC- : TION 4.10 OF THE CiTY CODE WHICH ORDINANCE iS INTENDED TO MANAGE AND ADMINISTER THE USE OF THE PUB- LIC RIGHT-OF-WAY IN THE PUBLIC INTEREST, AND TO PROVIDE FOR THE ISSUANCE AND REGULATION.OF RIGHT- OF-WAY PERMITS. The City of Ramsey Ordains: SECTION I. SUMMARY The purpose of this Ordinance Js to provide for the health, safety and well being of the citizens of Ramsey by pro- viding guidelines for the management and administration of the public right-of- way within the City. The City holds the right-of-way within its boundaries as an asset in trust for its citizens. The City and ~ther public entities have significant dol- lars in public funds to acquire, build and maintain the right-of-ways. The City rec- ognizes that some persons, by placing [heir equipment within these right-of- ways and charging citizens of the City for goods and s~rvices delivered thereby, are using this public property for private gain and profit. In response, the City hereby enacts this new Section of this 'Code relating to right-of-way permits and .management, together with an ordi- · nance making necessary revisions to 'other Code provisions. This Section imposes fair, efficient, competitively neu- · tral, uniform, and reasonable regulations · on the placement and maintenance of · equipment currently within its right-of- ways or to be placed therein. This Section is intended to complement the regulator roles of state and federal agencies. Under this Section, persons disturbing and obstructing the right-of-ways will bear a . fair share of the financial responsibility for their integrity. Finally, this Section pro- vides a recovery of out-of-pocket and projec(ed costs from persons using right- ' of-ways. ~ SECTION 2. EFFECTIVE DATE - ; This Ordinance shall take effect upon. 'its adoption and thirty (30) days after · publication according to law, subject to Charter Provision, SectionS.04.
