I'KINIEK'3 AI~I~ILIAVII Ul~ I'UBLIC:AIILIN <br /> <br />ORDINANCE #01-10 <br /> <br /> CITY OF RAMSEY <br /> ANOKA COUNTY <br /> STATE OF MINNESOTA <br /> AN ORDINANCE TO AMEND SEC- <br />: TION 4.10 OF THE CiTY CODE WHICH <br /> ORDINANCE iS INTENDED TO MANAGE <br /> AND ADMINISTER THE USE OF THE PUB- <br /> LIC RIGHT-OF-WAY IN THE PUBLIC <br /> INTEREST, AND TO PROVIDE FOR THE <br /> ISSUANCE AND REGULATION.OF RIGHT- <br /> OF-WAY PERMITS. <br /> The City of Ramsey Ordains: <br /> SECTION I. SUMMARY <br /> The purpose of this Ordinance Js to <br />provide for the health, safety and well <br />being of the citizens of Ramsey by pro- <br />viding guidelines for the management <br />and administration of the public right-of- <br />way within the City. The City holds the <br />right-of-way within its boundaries as an <br />asset in trust for its citizens. The City and <br />~ther public entities have significant dol- <br />lars in public funds to acquire, build and <br />maintain the right-of-ways. The City rec- <br />ognizes that some persons, by placing <br />[heir equipment within these right-of- <br />ways and charging citizens of the City for <br />goods and s~rvices delivered thereby, are <br />using this public property for private gain <br />and profit. In response, the City hereby <br />enacts this new Section of this 'Code <br />relating to right-of-way permits and <br />.management, together with an ordi- <br />· nance making necessary revisions to <br />'other Code provisions. This Section <br /> imposes fair, efficient, competitively neu- <br />· tral, uniform, and reasonable regulations <br />· on the placement and maintenance of <br />· equipment currently within its right-of- <br /> ways or to be placed therein. This Section <br /> is intended to complement the regulator <br /> roles of state and federal agencies. Under <br /> this Section, persons disturbing and <br /> obstructing the right-of-ways will bear a <br />. fair share of the financial responsibility for <br /> their integrity. Finally, this Section pro- <br /> vides a recovery of out-of-pocket and <br /> projec(ed costs from persons using right- <br /> ' of-ways. <br />~ SECTION 2. EFFECTIVE DATE <br />- ; This Ordinance shall take effect upon. <br />'its adoption and thirty (30) days after <br />· publication according to law, subject to <br /> Charter Provision, SectionS.04. <br /> Passed by the City Council of the City <br /> of Ramsey, Minnesota, on this 27th day <br /> of March, 2001. <br /> Thomas G.
