<br /> AN INTERIM ORDINANCE ESTABLISHING A MORATORIUM ON THE DEVELOP-
<br />MENT OF CERTAIN PARCELS OF LAND WITHIN THE cITY OF RAMSEY, ANOKA COUN-
<br />TY, MINNESOTA. ;i

<br />The City of Ramsey ordains: '-'
<br />SECTION 1. AUTHORITY
<br /> This Ordinance is adopted pursuant to that authority granted to the City by MSA
<br />462.355, Subd. 4, entitled "Interim Ordinance."
<br />SECTION 2. PREAMBLE AND PURPOSE
<br /> WHEREAS, the City of Ramsey is part of an area experiencing growth in population
<br />and employment; and
<br /> WHEREAS, as a consequence of growth in' this part of the region and adjacent
<br />areas, there has been significant traffic increases along the TH 169, TH 10, TH 101 and
<br />1-94 corridors, causing substantial delays at the individual corridor crossings of the
<br />Mississippi River during the rush hours; and
<br /> WHEREAS, this increased traffic congestion along these corridors has been recog-
<br />nized as a regional priority in the Minnesota Department of Transportation (Mn/DOT)
<br />Metro Division 2005 - 2025 Transportation System Plan, Metropolitan Council's
<br />Transportation Policy Plan; and
<br /> WHEREAS, the Anoka County Comprehensive Plan, the Henn, epin County
<br />Transportation Systems Plan, and the Comprehefisive Plans of the cities of Ramsey and
<br />Dayton contemplate the expansion of a Northwest'Metro roadway connection, involv-
<br />lng a Mississippi River crossing between Ramsey and Dayton; and
<br /> WHEREAS, Mn/DOT, Anoka County, and Hennepin County have ~xpressed a will-
<br />ingness to finance and participate in a Northwest Metro Corridor and River Crossing
<br />Study to consider a long-term option to address the relief of the highway corridors and
<br />river crossings; and
<br /> WHEREAS, the City of Ramsey acknowledges that it is in the best interest of the City
<br />to study the potential for a future river crossing and to examine the impacts of options
<br />on the cities, counties, and properties in the northwest metropolitan area; and
<br /> WHEREAS, the City Council finds that an interim ordinance placing a moratorium
<br />on the development of certain parcels is necessary to protect the planning process and
<br />the health, safety and welfare of the dtizens of Ramsey during the Northwest Corridor
<br />River Crossing Study process.
<br />SECTION 3. PROHIBITION
<br /> During the term of this .Ordinance, notwithstanding Chapter 9 of the City Code,
<br />entitled "Zoning and Subdivision of Land", no subdivision, rezoning, site plan
<br />approvals, conditional use permits or variances of any kind shall be permitted, except
<br />that applications for interim use permits for which no permanent or temporary build-
<br />ins is required may be considered. No applications for said subdivision, rezoning, site
<br />plan approvals, conditional use permits or variance shall be accepted on the parcels
<br />

<br />SECTION 4. UNDUE HARDSHIP EXCEPTIONS
<br />

<br />The City Council may grant an exception to the provisions of this Ordinance when,
<br />in its opinion, undue hardship or a practical.difficulty may result from strict compli:
<br />ance. In granting an exception, the City Council shall prescribe any conditions that it
<br />deems necessary to or desirable for the protection of the public interest. NO exception
<br />sha~J be granted unless the City Council finds:
<br />1. That there are special circumstances or conditions affecting said property such
<br />that the strict application of the provisions of this Moratorium Ordinance would
<br />deprive the petitioner of the reasonable use of petitioner's land.
<br />2. That the.exception is necessary for the preservation and enjoyment of a sub-
<br />stantial property right of the petitioner.
<br />3. That the granting of the exception will not be detrimental to the public welfare
<br />or injurious to other property in the area in which the property is situated.
<br />4. That the proposed exception will be harmonious with and in ta,ccordance with
<br />the specific objectives of the City's existing Comprehensive Plan and will not adverse-
<br />ly affect the planning process for adoption of amendments to the Comprehensive Plan
<br />above described.
<br />5. That the proposed use/subdivision will be consistent with the intent and purpose
<br />of'this Ordinance.
<br />SECTION 5. TERM
<br />The term of this Ordinance shall be for a period of twenty-four (24) months com-
<br />mencing with its effective date. The term may be extended after approval by the City
<br />Council for an additional period not exceeding six (6) months, as provided for in
<br />Minnesota Statutes, Section 462.355, Subd. 4.
<br />SECTION 6. PENALTIES
<br />Any person, firm, entity or corporation that undertakes any development activity
<br />in violation of the provisions of this Ordinance shall be guilty of a misdemeanor and
<br />shall be subject to any additional legal or equitable remedies available to the City.
<br /> SECTION 7. EFFECTIVE DATE '
<br /> This Ordinance shall take effect upon adoption and thirty (30) days after publica-
<br />tion according to law, subject to Charter Provision, Section 5.04.
