Subd. 7. Display. <br /> <br />go <br /> <br />All licenses shall be posted and displayed in plain view of the general <br />public on the licensed premises. <br /> <br /> b. Exclusive Tobacco Stores shall post a notice prohibiting the entering <br /> of the store by persons under 18 years or age which notice shall be in <br /> plain view of the general public on the licensed premises. The notice <br /> shall be at least 8 ½ inches by 11 inches in size. .0 ~' } ~ <br /> <br />Section 6. PROHIBITED SALES, paragraph c. of Ordinance 9~,~2 is amended to read as <br />follows: <br /> <br />c. By means of self-service methods whereby the customer does not need to <br /> make verbal or written request to an employee of the licensed premises in <br /> order to receive the tobacco, tobacco product, or tobacco related device and <br /> whereby there is not a physical exchange of the tobacco, tobacco product, or <br /> tobacco related device between the licensee or the licensee's employee, and <br /> the customer, unless the sale is by means of a vending machine controlled by <br /> an electronic device by an employee of the business. This paragraph c. does <br /> not apply to Exclusive Tobacco Stores. <br /> <br />Ordinance 98/,02, Section 8, SELF SERVICE SALES is amended to read as follows: <br /> <br />It shall be unlawful for a licensee under this ordinance to allow the sale of tobacco, <br />tobacco products, or tobacco related devices by any means where by the customer <br />may have access to such items without having to request the item from the licensee <br />or the licensee's employee and whereby there is not a physical exchange of the <br />tobacco, tobacco product, or the tobacco related device between the licensee or his <br />or her clerk and the customer unless the sale is by means of a vending machine which <br />is controlled by the licensee or his or her clerk. All tobacco, tobacco products, and <br />tobacco related devices shall either be stored behind a counter or other area not freely <br />accessible to customers, or in a case or other storage unit not left open and accessible <br />to the general public. Any retailer selling tobacco, tobacco products, or tobacco <br />related devices at the time this ordinance is adopted shall comply with this section <br />within sixty days. This paragraph does not apply to Exclusive Tobacco Stores. <br /> <br />Ordinance 9~2, Section 11. OTHER ILLEGAL ACTS is amended by the addition of Subd. <br />6. entitled Entering of Exclusive Tobacco Stores, which subdivision shall provide as follows: <br /> <br />Subd. 6. Entering of Exclusive Tobacco Stores. <br /> <br />It is unlawful for a person under 18 years to enter an Exclusive <br />Tobacco Store for the purpose of purchasing tobacco or tobacco <br />products, or for any other purpose. <br /> <br /> <br />
