Off-Sale Liquor License Ordinance Page 2 <br /> <br />7. Malt liquor. <br /> "Malt liquor" is any beer, ale, or other beverage made from malt by fermentation and <br /> containing not less than one-half of one percent alcohol by volume. <br />8. New construction. <br /> "New construction" is a building or premises which has never before been occupied for any <br /> purpose. <br />9. Non-intoxicating malt liquor. <br /> "Nonintoxicating malt liquor" is malt liquor containing not less than one-half of one <br /> percent alcohol by volume nor more than 3.2 percent alcohol by weight. <br />1 0. Off sale. <br /> "Off-sale" is the sale of alcoholic beverages in original packages for consumption off the <br /> licensed premises only. <br />1 1. On sale. <br /> "On-sale" is the sale of alcoholic beverages for consumption on the licensed premises only. <br /> 1 2. Package, <br /> "Package" is a sealed or covered container of alcoholic beverages. <br /> 13. Persor~. <br /> "Person" has the meaning given it in MS Section 645.44, Subdivision 7. <br /> 14. Retail. <br /> "Retail" is sale for consumption. <br /> 1 5. Sale and Sell and Sold. <br /> "Sale" and "sell" and "sold" means all barters and all manners of furnishing intoxicating <br /> liquor, including such furnishing in violation or evasion of law. <br /> 16. Table or sparklina wine. "Table or sparkling wine" is a beverage made without <br /> rectification or fortification and containing not more than 25 percent of alcohol by volume <br /> and made by the fermentation of grapes, grape juice or other fruits or honey. <br /> 17. Wine. "Wine" is sparkling and carbonated wine, wine made from condensed grape must, <br /> wine made from other agricultural products than sound, ripe grapes, imitation wine, <br /> compounds sold as wine, vermouth, cider, perry and sake, in each instance containing not <br /> less than seven percent nor more than 24 percent alcohol by volume for nonindustrial use. <br /> <br />APPLICATIONS FOR LICENSE TO BE VERIFIED <br />Every application for an "on sale" license shall <br />Administrator. <br /> <br />be verified and filed with the City <br /> <br />CONTENTS OF APPLICATION <br />In addition to information which may be required by the State Lliquor Control Commissioner, <br />the license application shall state: <br />1. Whether the applicant is a natural person, corporation, partnership or other form of <br /> organization. <br />2. If the applicant is a natural person, the following information shall be furnished: <br /> a. The true name, place and date of birth, and street residence address of applicant; <br /> b. Whether applicant has ever used or been known by a name other than his true name, and <br /> if so, what was such name, or names, and information concerning dates and places where <br /> used; <br /> c. The name of the business if it is to be conducted under a designation, name or style other <br /> than the full individual name of the applicant. <br /> <br /> <br />
