Off-Sale Liquor License Ordinance Page 7 remain unpaid for a period exceeding one (1) year after becoming due. 4. No license shall be granted to a foreign corporation. 5. No license shall be granted for any place which has a common entrance or exit between any two (2) establishments, except that a public concourse or public lobby shall not be construed as a common entrance or exit. 6. No off-sale license shall be granted unless the building proposed to be the licensed premises contains a minimum size of 4,000 square feet of area consisting of public sales display area and/or private storage area, all of which area must be devoted exclusively to the off-sale liquor business. 7, No off-sale license shall be granted within 1,000 feet of any elementary, secondary, or vocational school or within 1,000 feet of any church. For purposes of this measurement, the distance shall be determined by measuring the distance between the main entrance of the school and church and the main entrance of the licensed business. 8. No off-sale license shall be granted unless the proposed business is located in an area zoned to permit such a land use and unless the proposed business is located within the City's urban area, which urban area is as designated on the City's official zoning map. In addition, the premises shall be required to receive site plan approval from the City prior to building construction. 9. No off-sale license shall be granted unless the building housing the premises has been constructed in accordance with the State Building Code, Fire Code, and any other relevant building and construction safety requirements of the City of Ramsey, including the installation of security alarms. CONDITIONS GOVERNING LICENSE ISSUANCE The following conditions govern issuance of a license pursuant to this section: 1. Every license shall be granted subject to the provisions of this section and of any other applicable ordinance or law, including Chapter 340A of Minnesota Statutes. 2. The license shall be posted in a conspicuous place in the licensed premises at all times. 3. Every licensee shall be responsible for the conduct of the licensee's place of business and for the conditions of sobriety and order in the place of business and on the premises. 4. No "off-sale" licensee shall sell alcoholic beverage "on-sale". 5. No license shall be effective beyond the building space shown in the license application for such license. 6. No person under eighteen (18) years of age shall be employed in any rooms constituting the place in which alcoholic beverages are sold at retail. 7. No alcoholic beverage shall be sold or furnished or delivered to any intoxicated person, to any habitual drunkard, to any person under twenty-one (21) years of age or to any person to whom sale is prohibited by state law. 8. No licensee or employees of a licensee shall keep, possess, or operate or permit the or operation of any slot machine, dice, or any gambling device or apparatus on the licensed premises, or in any room adjoining the licensed premises, nor shall any such person permit any gambling therein, except as authorized by the State of Minnesota charitable gambling law. 9. No licensee shall knowingly permit the licensed premises or any room in those premises, or any adjoining building directly or indirectly under the licensee's control, to be used as a resort for prostitutes. 10.
