C. Fencing. <br /> i. Temporary fencing. The entire <br /> enc osure must be at least four (4) feet In <br /> height. The openrng between the bottom of the <br /> fence and the ground or other surface shall be <br /> not more than three (3) inches. All outdoor <br /> fence or wall openings or outdoor points of en- <br /> try into the pool area shall be equipped With <br /> self-closing and self-latching devices. <br /> iiL AIx~ve ground Swimming Pools. All <br />above-ground Swimming Pools that have a min- <br />imum side-wall height of four (4) feet need not <br />be fenced, but shall have removable steps, <br />Which steps shall be removed when the Swlmm: <br />lng P~ol !s unattended. In the event that an ac- <br />cessory deck to the Swimming Pool is con- <br />struqted which !s. adiacent to any part of the <br />Swimming Pool, said deck shall include on its <br />:~ entire outside' perimeter~ a 36 inch :high guard <br />;. rail. The secured cover <br /> shall be constructed of a material end be so <br /> secured as to be impenetrable by toddlers· <br /> D. Utility lines. No person shall build, con- <br /> struct, situate or install a Swimming Pool or <br /> Spa beneath any overhead utility line or ease- <br /> ment. In addition, no Swimmi.ng Pool or Spa <br /> may be installed over any underground utility <br /> line or easement. <br /> E. Noise. <br /> i. The Swimming Pool or Spa shall be <br /> designed, constructed and sited in such a way.' <br /> as to limit noise generated by its mechanical <br /> equipment and so as not to permit such equip- <br /> ment from creating a nuisance end/or affect <br /> the reasonable use and enioyment of adlacent <br /> property owners· <br /> ii. The Swimming Pool and/or Spa shall be <br /> sited on the parcel so that its. mechanical <br /> equipment,, including heating and filtering <br /> equipment is located at least 30 feet from the <br /> inhabited portion of neighboring residential <br /> structures. <br /> F. Lighting. Lights used in coniunction with a <br /> Swimming Pool and/or Spa shall be located and <br /> constructed so as to deflect away from adlacent <br /> property and in such a manner that they do not <br /> <br />~-create a nbisance or affect the reasonable use <br />and enioyment of adjacent property. <br /> G. Pool Walkway Deck and Deck Drains. <br />Unobstructed deck areas not less then 48 inches <br />wide shall be provided to extend entirely <br />around each inground Swimming Pool. Swimm- <br />ing Pool decks shall be constructed above, but <br />not more than 9 inches above, the normal water <br />line. The deck area shall be constructed of im- <br />pervious material, and the surface shall be Such <br />as to be smooth and easily cleaned and of non- <br />sup construction. GE'NERAL PROVISIONs ' ' <br /> · A. Title <br /> This Ordi0ance shall be known as the City o! <br /> Ramsey S~Nimming Pool and Spa Ordinance. <br /> B. Findings and Purpose <br /> · The City Council finds that there is an in. <br /> creasing number of Swimming Pools and Spas <br />being constructed within the City of'Ramsey. <br />The Cffy Council also finds that swimming pool,~ <br />and spas are .inherently dangerous unless pro- <br />perly constructed, mein{ained and secured· It <br />the purpose and intent of this Ordinance tc <br />' establish construction and fencing require- <br />'merits for Swimming Pools and Spas in order tc <br />protect the health, safety and general welfare <br /> of the residents of the City of Ramsey. C. Definitions <br /> Swimming Pool. Shall be defined as any <br /> swimming pool, permanent or portable, above <br /> ground or below ground, and which is more <br /> than lwenty-four (24) inches in depth and has a <br /> s0rface area which exceeds one hundred (100) <br /> square feet. <br /> Spa. Shall be defined as a unit primarily <br /> designed for therapeutic and/or recreational <br /> use, which is not drained, cleaned, or refilled <br /> for each individual. It may include, but not be <br /> limited to: hydroiet circulalion, hot water, cold <br /> water, mineral baths, air induction'bubbles, or <br /> any combination thereof· Industry terminology <br /> for a spa includes, Out is not limited fo: lhera- <br /> peutic pool, hydrotherapy pool, whirlpool, hot <br /> spa, and hot tub. <br /> D. Applicability. <br /> This Ordinance shall apply to all new Swimm- <br /> ing Pools or Spas, and all existing swimming <br /> pools or spas. Existing Swimming Pools and <br /> Spas shall be brought into compliance with the <br /> requirements of Section 3 of this Ordinance <br /> where reasonably feasible within six (6) months <br /> of the effective date of this Ordinance. <br /> SECTION 2..ADMINISTRATION AND PER- <br /> MIT <br /> A. Build. lng Permit. Prior to Construction of a <br /> Swimming POol or Spa having a water volume <br /> of 5,000 or more gallons a building permit <br /> issued pursuant to th6 Uniforrh Building Code <br /> shall be required· Said Building Permit shall be <br /> in lieu of the Pool/Spa permit required by <br /> Paragraph B. Below. <br /> B. Permit and Fee. Prior to construction of <br /> any Swimming Pool or SPa which wil have a <br /> water volume of less than 5,000 gallons, a per- <br /> mit must be obtained from the City's Building <br /> Official There shall be a permit fee, the <br /> amount of which shall be as established by City <br /> Council Resolution pursuant to Chapter of the <br /> City Code. The permit issued pursuant to this <br /> Paragraph shall be known as the "Pool/Spa <br /> Permit." <br /> C. Permit Application. Application for a <br /> Pool/Spa permit shall be made on a form sup- <br /> plied by the City, and shall contain all informa- <br /> tior~ as stated on the application, including, Put <br /> not limited to the following: <br /> i. Legal descr'iption and the fee owner of <br />fha parcel on which Swimming Pool/spa is pro- <br />posed to be constructed. <br /> ii Proposed location of Swimming Pool or <br />Spa On the parcel. <br /> Ill. Parcel dimensions. <br /> iv. CON STRUCTION STANDARDS. <br /> A'. Construction methods. <br /> Due p~ecautions shall be taken during the <br />construcfioh 'of a Swimming Pool or Spa to <br />avoid damage, hazards, or inconvenience to ad- <br />jacent or nearby property, and to assure that <br />proper care is taken in stock piling excavated <br />material in order to' avoid erosion, dust, or <br />other infringement onto adjacent property. <br /> B. Setback requirements. <br /> i. A Swimming Pool or Spa may not be <br />located within any rear, front Pr side yard set- <br />back as 0rescrlbed for the zoning district in <br />which the parcel is located. <br /> ii. A Swimming Pool or Spa may not be <br />located closer than four (4) feet to the principal <br />structure located on the parcel where the <br />Swimming Pool or Spa is to be constructed. A <br />Swimming Pool or Spa may not extend closer to <br />the front lot line of the parcel than the principal <br />structure located on said parcel, except that on <br />residential parcels of one acre or more in size, a <br />Swimming Pool or Spa may be coh{t?ucted <br />closer to the front lot line than the principal <br />structure, provided, that such Swimming Pool <br />or Spa is constructed within the mtn imum set- <br />back of two hund~'ed (200) feet. - <br /> II. NO Swimrfling Pool or Spa may be con- <br />structed within twenty (20) feet of any portion <br />of an on-site sewer system or any private water <br /> <br /> PRINT}, <br />":.' 0RD! If <br />deck drains are provided, drain pipe lines shall <br />be at least two inches in diameter; drain open- <br />ings shall have an open area of at least four <br />times the cross-sectional area of the drain pipe. <br />Deck drains shall not be connected to the recir- <br />culation system piping. <br /> H. Swimming Pool Drainage. To the extent <br />feasible, back-flush water or water from pool <br />drainage shall be on the owner's property or in- <br />to approved public drainage ways. Water shall <br />not drain onto adjacent or nearby private land. <br /> 'l/Electrical Requirements. All electrical in- <br />stallations and current-carrying~ electrical con- <br />ductors shall conform to the State Electrical <br />C0~Ie and each Swimming Pool or Spa shall <br />receive those permits and inspections as re- <br />quired by the State Electrical Inspector. <br /> SECTION 4. PENALTY. <br /> Any person convicted of a violation of any of <br />the provisions of this ordinance shall be punish- <br />ed by a fine of not more than seven hundred <br />($700) dollars or by imprisonment for a period <br />of not more than ninety [90) days, or both. <br /> SECTION S. EFFECTIVE DATE. <br /> This Ordinance becomes effective upon its <br />passage and thirty (30) days after its publica- <br />tion according to law, subject to City Charter <br />Provision, Sectioh 5.04. <br /> PASSED by the City Council of the City of <br />Ramsey, Minnesota, the 9th day of May, 1989. <br />-s-Gary R.
