<br /> 13) HABITABLE ROOM: A room or enclosed
<br />floor space used or intended to be used for liv-
<br />ing, sleeping, cooking or eating purposes; ex-
<br />cluding bathrooms; water closet compartments,
<br />laundries, furnace rooms, unfinished base-
<br />ments, pantries, utility rooms, foyers, com-
<br />municating corridors, stairways, closets,
<br />storage spaces, and attics.
<br /> 14) INFESTATION: The presence within or
<br />around a dwelling of any insect, rodent, or other
<br />pests.
<br /> 15) KITCHEN: A habitable room intended to
<br />be used for the cooking of food or the prepara-
<br />tion 6f.meals.
<br /> 16) MAINTENANCE: To keep in a good state
<br />of repair; to preserve from deterioration.
<br /> 17) MULTIPLE FAMILY DWELLING: A
<br />building or port!on thereof used for occu panty
<br />b~/ three or more families living independently
<br />of eacll other with separate kitchen and
<br />bathroom facilities.
<br /> 18) NONCOMBUSTIBLE: Any material or
<br />combination of materials which will not ignite
<br />or support combustion during a five (5) minute
<br />exposure. (Refer to 1973 UBC, Section 415 or
<br />appropriate section of later edition.)
<br /> 19) OCCUPANCY: The purpose for which a
<br />building, or part thereof, is used or intended to
<br />be used.
<br /> 20) OCCUPANY: Any person residing in a
<br />dwelling unit'or rooming unit.
<br /> 21) OPERATOR: The owners or their agents
<br />who have charge, care, control, or management
<br />of a btJilding or part thereof.
<br /> 22) OWNER: Any person, group, partnership,
<br />corporation, or other enity, alone, jointly or
<br />severally with others, shall be in actual posses-
<br />si'on of, or have charge, care or control of, any
<br />building or a portion thereof within the City as
<br />owner, employee or agent of the owner, or as
<br />trustee or guaradian of the estate or person of
<br />the title holder. Any such person representing
<br />the actual owner shall be bound to comply with
<br />the provisions of this article to the same extent
<br />as the owner.
<br /> 23) REFUSE: All solid waste products or
<br />those having the character of solids rather than
<br />liquids in that they will not flow readily without
<br />addiional liquid and which are composed wholly
<br />or partly of such materials as garbage, swill,
<br />sweepings, cleanings, trash, rubbish, litter, in-
<br />dustrial solid wastes or domestic solid wastes,
<br />organic wastes or residue of animals sold as
<br />meat, fruit or other vegetable or animal matter
<br />from kitchen, dining room, . market, food
<br />establishment or any pi@ce dealing in or han-
<br />dling meat, fowl, fruit, grain or vegetables;
<br />ofal, animal excreta, or the carcass of animal~
<br />trees or shrub traimmings, or other waste matter
<br />resulting from the demolition, alteration or con-
<br />struction of buidings or structures, ac-
<br />cumulated waste materials, cans, containers,
<br /> junk vehicles, ashes, tires, junk or other
<br /> substance which may become e nuisance.
<br /> 24) REPAIR: To restore to a sound and ac-
<br />ceptable state of operation, serviceability, or
<br />appearance in the determinalion of the City
<br />Building Official.
<br /> 25) RODENT HARBORAGE: Any place
<br />wher~ rodents live, nest or seek shelter.
<br /> 26) SEWER SYSTEM: A functioning sewer
<br />connection free from defects, leaks or obstruc-
<br />tions With sufficienl c. apacity to drain all fix-
<br />tures or appliances which feed into it. The
<br />sewer system, be it municipal or private, must
<br />be capable of disposing of sewage in a safe,
<br />sanitary, and adequate manner.
<br /> 27) U.B.C.: Uniform Bu.]lding Code.

<br /> SECTION 11g.193E - FACILITIES FOR
<br />STORAGE AND DISPOSAL OF RUB.BISH AND
<br />GARBAGE: Every 'owner of a dwelling unit
<br />shall be fes'ponsible fbr prpviding end maintin-
<br />ing facilities for the storage and disposal of
<br />rubbish, end garbage and for arranging for the
<br />collection of this material. In the case of mutli-
<br />pie family dwellings, these responsibilities shell
<br />be those of the occupants.
<br />SECTION 110.i93F - RODENT HARBORAGE
<br />N OCCUPIEDAREAS~ It shall be therespon.
<br />sibility of the owner of a dwelling unit to pre-
<br />vent the formation of rodent harborage ri or
<br />about the premises. It shall further be the re-
<br />spon~ibility of said owner to-prevent the place-
<br />merit or accumulation of materials that may
<br />serve as food for rodents in a site a~:cessible to
<br />rodents in these areas. - - - ·
<br /> SECTION 110.193G - PEST OR VERMIN EX-
<br />TERMINATION: The owner of a dwelling or
<br />dwelling units'shail be responsible'for the ex-
<br />termination of pest or vermin infestations on
<br />the premises. '
<br />ARTICLE IV: BASIC SAFETY REQUIRE-
<br />MENTS FOR ' INTERIOR AND EXTERIOR
<br />MAINTENANCE
<br /> SECTION 110.194A KITCHEN FACILITIES:
<br />Kitchen facilities in every dweling shall be
<br />maintained in the following manner:
<br /> 1) A ~,itchen sink shal be in good working
<br />condition and properly connected to an approv-
<br />ed water supply system which provides at all
<br />times heated and unheated running water under
<br />pressure, and which is connected lo an approv-
<br />ed sewer system.
<br /> 2) Cabinets and/or shelves and counters or
<br />tables shall be of sound construction furnished
<br />wilh surfaces that are easily cleanable and that
<br />will mot impart any toxic or deleterious effect
<br />on food.
<br /> 3) A stove or similar device for cooking food
<br />and a refrigerator or similar device for the safe
<br />storage of food shall be properly maintained
<br />with all necessary connection for safe, sanitary,
<br />and efficient operation.
<br /> 4) WINDOWS, DOORS, AND SCREENS:
<br />Every window, exterior doorway, and hatch
<br />way shall be substantially tight and shall be
<br />kept in sound condition arid repair.
<br /> Every window, other than a fixed window or
<br />storm window, shall be capable of being easily
<br />opened.
<br /> 5) LIGHTING: Al electrical light fixtures
<br />shall be kept in a good state of repair.
<br /> 6l MINIMUM ELECTRICAL STANDARDS:
<br />Every dwelling unit and all public and common
<br />areas supplied with electrical service, function-
<br />ing overcurrent protection ,devices, electrical
<br />outlets, and electrical fixtu[res shall be main-
<br />tained in good and safe working condition, and
<br />shall be connecled to a source of electl~ic power
<br />in a manna? prescribed by the ordinances of the
<br />City and by the laws of the State of Minnesota.
<br />7l FLOORS, INTERIOR WALLS, AND CEIL-
<br />INGS: Every floor, interior well and ceiling
<br />shall b~ kept in s~und condition and good
<br />repair. Every floor shall be free of loose,
<br />warped, protruding or rotted flooring materiels.
<br />Every interior wall and ceiling Shall'be free of
<br />holes and. lai~ge cracks and loose plast~r and
<br />shall be maintained in a tight, weatherproof
<br />condition. ' ' '
<br /> 8) STAIRWAYS, PORCHES, AND
<br />BALCONIES: Every stairway,.inside or outside
<br />of a dwelling, en~ every porch dr balcony shall
<br />
<br />and system~ in accordance wilh Chapter 5-1021
<br />of N.F.P.A. Std. 101.
<br />SECTION 110.195F - AUTOMATIC ALARM
<br /> 1) All multiple dwellings having in excess of
<br />four (4) dwelling units shall provide e manually
<br />operated alarm system ci~pable of ~lerting all
<br />the occupants of the structure. Each such
<br />alarm system shall be activated by a manual
<br />pull station located at each exit door and by an
<br />automatic device located in the utilities and/or
<br />room in which the heat supply is located. Such
<br />device shall be a product of combustion detec-
<br />tor other than heat, bearing the approval of the
<br />Underwriters Laboratories OF Factory Mutuals
<br />Testing Service for such service, or the Inter-
<br />notarial Conference of Building Officials.
<br /> 2) Every dwelling unit within an apartment
<br />house, lodging house or hotel, and every guest
<br />room in a lodging house or hotel used for sleep-
<br />ing shall be provided with a smoke detector
<br />capable of detecting products of combustion
<br />olheJ' than heat and conforming to the require-
<br />ments of the Underwriters Laboratories, or ap-
<br />proved by-the International-Conference of
<br />Building Officials. When actuated the detector
<br />shall provide an alarm in the dwelling unit or
<br />guest room.
<br /> E, ECTON 110.~95G - FIR'E PROTECTION
<br />SYSTEMS: 'All fixed an p~rlable fire protection
<br />systems add appliances must be accessible and
<br />maintained fo~: immediate emergency use.
<br /> SECTION 110.195H . PROHIBITING INSIDE
<br />CON N ECTIOt~ OF EXTERNAL APPLI-
<br />ANCES: II shall be unlawful for the owner of
<br />any multiple dwelling lo allow electrical drop
<br />cords~ e~ension cords or any electrical wire to
<br />run from any electrical outlet from Inside the
<br />multiple dwelling for service lo an electrical
<br />appliance'oufside of a multiple dwelling.
<br />ARTICLE VI: PROVI SIGNS AND
<br />MAINTENA. NCE OF BASIC SERVICES
<br />AND UTILITIES IN MANUFACTURED
<br />HOME PARKS
<br /> SECTION 110.196A - PLUMBING, HEATING,
<br />AND ELECTRICAL SERVICE: Every owner of
<br />a mobile home park shall be responsible for the
<br />provision and maintenance of plumbing,
<br />heating and eleclrical service to each mobile
<br />home. All utilities shall be constructed, install-
<br />ed and maintained in accordance with the laws
<br />of the state, the recommendations of the state
<br />health department, and the ordinances and re-
<br />quirements o~ the City.
<br /> SECTION 110.196B - ILLUMINATION: Every
<br />public hall and stairway in every mobile park
<br />community building shall be adequately lighted
<br />by natural or electric light at all times so as to
<br />provide effective illumination in all parts
<br />thereof.
<br />ARTICLE VII :. UNFIT
<br />FOR HUMAN HABITATION
<br /> SECTION 110.197A--DECLARATION: Any
<br />dwelling unit which is demage~l, decayed, dilap.
<br />idated, unsanilary, unsafe, vermin or rodent In-
<br />fested, or which lacks provis'ion for illumina-
<br />tion, ventilation, o~ s,~r~i'tary facilities to the ex-
<br />tent thal~, the defe,cts create a hazar~J to thi~
<br />health, safety, or w~lfare o(tl~e occul~ants or of
<br />the public _may be declared unfit fqr human
<br />habitation Whenever any dwelljng unit has
<br />.~een declared unfit for human.hab~tahon the c~-
<br />ty I~uilding Official shall order sa. me vacated
<br />within a reasonable time and shall post a
<br />placard on same indicating that it !,~ unfit for
<br />human habitation.
<br /> SECTION 110.197B · VACATED RUJLDING:
<br />It shall be unlbwful for a vacant dwelling unit
<br />which has been declared unfit for human
<br />habitation as provided in Section I10.197A to be
<br />used for human habitation until the defective
<br />conditions have been corrected and certificate
<br />
<br /> SECTION 110.198G SEVERABILITY:
<br />Should any portion of this ordinance be found 1o
<br />be violative ~f any provisions of the ConstJtullon
<br />of the State of Minnesota or the United States of
<br />America, such a finding will affect only such
<br />portion and the remainder of this ordinance
<br />shall continue in full force and effect.
<br /> SECTION 110.198H · EFFECTIVE DA~E:
<br />This ordinance becomes effective thirty (30)
<br />days after publi.catlon, subject to City Charter,
<br />Section 5.04.
