170.065 STANDARDS FOR ACCEPTING DEDICATION OF LAND FOR PUBLIC <br /> <br />170.066 <br /> <br />PARK PURPOSES <br /> <br />Land proposed to be dedicated for public purposes <br />shall meet identified needs of the City. <br /> <br />Prior to dedication for public purpose, the <br />subdivider shall deliver to the City Attorney, an <br />abstract of title or registered property abstract <br />for such dedication. Such title shall vest in the <br />City good and marketable title, free and clear of <br />any mortgages, liens, encumbrances, assessments and <br />taxes. The conveyance documents shall be in such <br />form acceptable to the City Council. <br /> <br />Co <br /> <br />The required dedication shall be made at time of <br />final plat approval. <br /> <br />De <br /> <br />The removal of trees, topsoil, storage of <br />construction equipment, burying of construction <br />debris, or stockpiling of surplus soil is strictly <br />forbidden without the written approval of the City <br />Council. <br />Grading and utility plans, which may affect or <br />impact the proposed park dedication, shall be <br />reviewed and approved by the Parks and Recreation <br />Commission prior to dedication, or at such time as <br />is reasonably determined. <br /> <br />To be eligible for park dedication credit, any land <br />to be dedicated as a requirement of this Section <br />shall be useable, developable land for use for park <br />and recreation purposes and shall be at a location <br />convenient to the people to be served. <br /> <br />CASH PAYMENT <br /> <br />In lieu of land dedication, the City Council may require <br />the subdivider to contribute a cash payment. The value <br />of such payment shall be either the greater amount <br />established by a specified contribution per dwelling unit <br />or a percent of fair market value of the undeveloped land <br />commensurate with the percent of land which otherwise <br />would have been required under Sections 170.062 and <br />170.063 of this chapter. "Fair Market Value", for <br />purposes of this Section 170.066, shall be determined as <br />of the time of filing the final plat in accordance with <br />the following: <br /> <br />The city Park and Recreation Commission and <br />subdivider may agree upon a recommendation to the <br />City Council as to the fair market value. <br /> <br />3 <br /> <br /> <br />
