170.069a <br /> <br />170.070 <br /> <br />170.071 <br /> <br />170. 072 <br /> <br />170.073 <br /> <br />EXCEPTION TO REQUIRED IMPROVEMENTS <br /> <br />No subdivider shall be required to construct or make <br />improvements on the Mississippi River Corridor Trail. <br /> <br />AGREEMENT AS TO DEDICATION <br /> <br />Agreements as to the requirements in Sections 170.061 through <br />170.069 above shall be made prior to preliminary plat <br />approval. Failure of the City Council and subdivider to reach <br />agreement regarding the matters in Sections 170.061 through <br />170.069 above shall constitute denial of the preliminary plat. <br /> <br />EXCEPTIONS <br /> <br />In the case of a request to divide a lot which is a part of <br />a recorded plat where the division is to permit the adding of <br />a parcel of land to an abutting lot which does not create a <br />new buildable lot, the subdivider shall be exempt from <br />complying with any procedural requirements of this ordinance. <br /> <br />APPLICATION TO MINOR SUBDIVISIONS <br /> <br />In the event of a minor subdivision, the provisions of this <br />Chapter shall apply to the new lots being created rather than <br />the gross area being subdivided. <br /> <br />APPLICATION TO RESUBDIVISION <br /> <br />ae <br /> <br />In the event of a resubdivision of a parcel for which <br />park dedication requirements have previously been met, <br />no additional park dedication requirements shall be <br />imposed as a result of the resubdivision providing the <br />overall density of development of the parcel remains the <br />same as the density allowed under the zoning in effect <br />at the time of the initial subdivision. <br /> <br />In the event that park dedication requirements were met <br />through the use of a fee per dwelling unit or based on <br />the value of the improvement, additional park dedication <br />shall be made for each new lot created under <br />resubdivision. <br /> <br />The park dedication fee shall be based on the specified <br />contribution per dwelling unit for residential properties <br />resulting from the resubdivision. <br /> <br />6 <br /> <br /> <br />
