PAYMENT "'.
<br />In lieu of land dedication, the City Council
<br />may require the subdivider to contribute a cash
<br />payment. The value of such payment shall be
<br />eith,er the greater, amount established by a
<br />specified contribution per dwelling unit or a
<br />pei'cent o! fair market value of the undeveloped
<br />land commensurate with the percent of land
<br />which otherwise would have been required
<br />under Sections 170.062 and 170.063 of this
<br />chandler. "Fair Market Value", for purposes of
<br />this Section 170.066, shall be determined as of
<br />the lime of filing the final plat in accordance
<br />with the following:
<br /> A. The City Park and Recreation Commission
<br />and subdivider may agree upon a recommenda-
<br />tion to the City Council as to the fair market·
<br />value..
<br /> B. The City Council after reviewing the Park
<br />and Recreation Commission's recommendation,
<br />may agree with the subdivider as 'to the fair
<br />market valqe. If' agreement is not reached in
<br />this manner, then fair market value shall be
<br />determined in accordance with t. he following:
<br /> The fair market value as determined by the
<br />City Council based upon appraisals, accepted
<br />purchbse agreements, comparable market
<br />transactions or other pertinent records as
<br />determined by the City Council.
<br /> The cash contribution per dwelling unit, effec-
<br />tive upon the effective date of this ordinance
<br />shall be in accordance with the following
<br />schedule:
<br /> HOUSING TYPE

<br /> The City Council, upon review and recom-
<br />mendation of the Park and Recreation Commis-
<br />sion shall annually determine by resolution the
<br />park and dedication fee per residential unit.
<br /> If, at the option of the City Council it is
<br />determined that a cash dedication shall be
<br />made, said cash shall be placed in a special
<br />fund for Parks and Recreation use and depos-
<br />lied by the developer with the City prior to final
<br />plat approval.
<br /> 170.067 COMBINATION OF LAND'DEDICA.
<br />TION AND CASH PAYMENT
<br /> in appropriate plats, a combination of land
<br />and cash may be required by the City Council.
<br />in the event a combination of land and cash is
<br />requlrgd, the amount of land to be dedicated
<br />shall be credited against the total park dedica-
<br />tion requirement and the remaining cash con-
<br />tribution shall be based on the greater of the
<br />specified cash contribution per dwelling unit or
<br />the fair market value of the land, When deter-
<br />mining the cash cont~lbutlon for the remaining
<br />acreage, the overall density of the plat shall be
<br />the basis for determining the potential number
<br />of dwerling units per acre.
<br /> 170.068 SCENIC EASEMENTS
<br /> In appropriate plats, as determined by
<br />

<br />at the time the final plat is approved 1o dedicate

<br />which may be required as a trail link connecto~

<br />street right-of-ways· No park dedication credit
<br />will be given for these connecting links or con-
<br />struction thereof.
<br /> D. Establish par'k boundary corners' for the
<br />.purpose of erecting park limit signs. The devel-
<br />oper shah contact the appropriate Parks and
<br />Recreation Department personnel for the pur-
<br />pos~ of identifying park properly corners.
<br /> E. Provide sufficient public road access of no
<br />less then 300 feet for heighborhood Parks, and
<br />additional frontage for community parks.
<br /> F. Where inJpravements are to be made, the
<br />subdivider shall submit a site,-~'ading and
<br />landscape plan prepared by a registered
<br />engineer Or landscape architect to the City for
<br />approval during the preliminary plat process.
<br /> 170.069a EXCEPTION TO REQUIRED IM-
<br />PROVEMENTS
<br /> No subdivider shall be required to construct
<br />or make improvements on the Mlss~SSippi River
<br />Corridor Trail.
<br />170.070 AGREEMENT AS TO DEDICATION
<br />Agreements as to the requirements in Sec-
<br />tions 170.061 through 170.069 above shell be
<br />made prior to preliminary Plat approval.
<br />Failure of the City Council end subdivider to
<br />reach agreemeht regarding the matters in Sec-
<br />tions 170,061 through 170,069 above shall con-
<br />statute denial of the preliminary plat. 170.071 EXCEPTIONS
<br /> In the case of a request to divide a lot which
<br />is a part Of a recorded plat where the division is
<br />to permit the adding of a parcel of lahd to an
<br />abutting lot which does not create a new
<br />bUildable lot, the subdivider shall be exempt
<br />from complying with any procedural require-
<br />ments of this ordinance.
<br /> 170.072 APPLICATION TO MINOR SUE-
<br />DIVISIONS
<br />
<br /> In the event of a minor subdivision, the provi-
<br />sions of this Chapter shall apply to the new lots
<br />being created rather than the gross area being
<br />subdivided.
<br />170.073 APPLICATION TO RESUBDIVISlON
<br />A. In the event of a resubdlvision of a parcel
<br />fp~. which park dedication requirements have
<br />p~evio, usl¥:been met, no additional ~ark dedica-
<br />tion requirements ~hall be imposed aS a.result
<br />of the res~bdivision providing the overall densi-
<br />ty of development of the parcel remains the
<br />same aS the density allowed under the zoning in
<br />effect at the tim~ of the initial subdivision.
<br /> B. In the event that park dedication require-
<br />ments were met through the use of a fee per
<br />dwelling unit or baSed on-the value of the im-
<br />provemeht, additional park dedication shall be
<br />made for each new lot created under resubdlvi-
<br />sion.
