"Incinerator" means any furnace or other device used in the process of <br />burning solid waste, hazardous waste, medical waste or special waste for the <br />purpose of reducing the volume of the waste by removing combustible material. <br /> <br />"Medical Waste" means all segregated, non-recycled wastes other than kitchen <br />or office wastes produced by hospitals, clinics, doctors' and dentists' offices, <br />funeral homes, veterinary clinics, and other medical and research facilities. <br />These wastes include infectious wastes as defined by part 7035.0300, subpart <br />48 of Minnesota Rules, or other relevant rule or statute defining infectious <br />wastes, pathological waste, and laboratory wastes. <br /> <br />"Solid Waste" means garbage, refuse, and other discarded solid materials, <br />except animal waste used as fertilizer, including solid waste materials resulting <br />from industrial, commercial, and agricultural operations, and from community <br />activities. Solid waste does not include earthen fill, boulders, rock, and other <br />materials normally handled in construction operations, solids or dissolved <br />material in domestic sewage, or other significant pollutants in water resources, <br />such as slit, dissolved or suspended solids in industrial waste water effluents, <br />dissolved materials in irrigation return flows, or other common water <br />pollutants. <br /> <br />"Special Waste" means any waste material not considered hazardous or solid <br />waste which has been determined by the Minnesota Pollution Control Agency or <br />Environmental Protection Agency to require special handling or treatment prior <br />to disposal. <br /> <br />Co <br /> <br />Nothing contained herein shall prohibit the use of incinerator burning of solid <br />waste as defined herein generated on the premises by incinerators lawfully <br />permitted and presently in use within the City. <br /> <br />SECTION 3. EFFECTIVE DATE. <br /> <br />This Ordinance becomes effective upon its passage and thirty (30) days after its <br />publication according to law, subject to City Charter Provision, Section 5.04. <br /> <br />SECTION 4. ORDINANCE SUMMARY FOR PUBLICATION. <br /> <br />The following official summary of Ordinance #89-26 has been approved by at least <br />four-fifths vote of the members of the Ramsey City Council as clearly informing the <br />public of the intent and effect of the ordinance and it is this Ordinance Summary that will <br />be published in the City's official newspaper to wit: <br /> <br />It Ds the intent and effect of Ordinance #89-26 to amend the City's Zoning Code <br />by prohibiting the burning of solid waste, hazardous waste, medical waste or <br />special waste by the use of an incinerator or hazardous waste incinerator. The <br />text of the ordinance contains definitions of those terms described above. <br /> <br />A printed copy of the ordinance is available for interpretation by any person during <br />regular office hours at the Ramsey Municipal Center. <br /> <br /> <br />
