170.015I <br /> <br />Normal maintenance of a <br />structure is permitted. <br />necessary non-structural <br />alterations which do not <br />nonconforming use. <br /> <br />non-conforming use and/or <br /> Maintenance may include <br /> repairs and incidental <br /> enlarge or intensify the <br /> <br />Buildings meeting City standards on setbacks as listed <br />in Section 170.016 shall in no case be considered <br />nonconforming for the setbacks. <br /> <br />When any lawful non-conforming use has been changed to <br />a conforming use, it shall not thereafter be changed to <br />any unlawful non-conforming use. <br /> <br />The City Zoning Administrator shall conduct an inspection <br />on a periodic basis of all non-conforming uses and report <br />the findings to the Planning and Zoning Commission and <br />the City Council within sixty (60) days of his inspection <br />for their information. <br /> <br />CONFORMING USE DESIGNATION FOR EXISTING USES IN "4 IN 40" <br /> <br />DENSITY DISTRICTS <br /> <br />No uses lawfully existinq in the rural residential districts (Rural <br />Service Area, Rural Transition Area, and Urban Reserve Area) prior <br />to January 1, 1990 shall be considered a non-conforming use as a <br />result of adoption of the residential density overlay districts. <br /> <br />170.015J HOME OCCUPATIONS <br /> <br />Intent: To provide peace, quiet, and domestic tranquility within <br />all residential neighborhoods, within the City, and in order to <br />guarantee to all residents freedom from excessive noise, excessive <br />traffic, nuisance, fire hazard and other possible effects of <br />commercial uses being conducted in residential areas. <br /> <br />No home occupation shall be permitted without the prior issuance <br />of a conditional use permit. <br /> <br />Ail home occupations authorized by conditional use permit shall <br />conform to the following standards: <br /> <br />a) <br /> <br />Permitted home occupations shall not be conducted in any <br />building on the premises other than the building which <br />is used by the occupant as the private dwelling; and, <br />furthermore, that not more than one (1) room may be used <br />for such purpose. <br /> <br />b) <br /> <br />No interior or exterior business sign shall be permitted <br />unless authorized by the sign regulations for residential <br />districts. <br /> <br />10 <br /> <br /> <br />
