DEVELOPMENT ELIGIBILITY WITHIN THE R-1R ZONING DISTRICT <br /> <br />INTENT: The "4 in 40" overlay district provides a density of <br />development which is significantly lower than that previously <br />permitted. As a result, the eligibility of parcels to develop is <br />determined in accord with the following: <br /> <br />The size of the parcel which shall determine the number of eliqible <br /> <br />residential units which can be developed on the parcel will be the <br />parcel size and state of development as of January 1, 1990t <br /> <br />When a parcel acreage is not evenly divisible by ten (10) allowing <br />for a pro rata density of four (4) units per forty (40) acres, an <br />additional lot may be developed only if the size of the fractional <br />parcel is at least 75% of that required for a single or an <br />additional lot. Eligible units per parcel are as follows: <br /> <br />Parcel Size <br /> <br />Eligible Units <br /> <br />7.5 to 17.49 acres <br />17.5 to 27.49 acres <br />27.5 to 37.49 acres <br />37.5 to 40.0 acres <br /> <br />DEVELOPMENT LIMITATIONS <br /> <br />1 unit <br /> <br />2 units <br />3 units <br />4 units <br /> <br />Ail subdivisions in the R-iR zoninq district shall be platted <br />and the following covenants at a minimum shall be filed on the <br />final plat: <br /> <br />- A covenant clearly stating the development eligibility <br />status of the parcel. <br /> <br />- A covenant clearly restricting the development of the <br />remainder of the parcel if all land is not fully incorporated <br />into building lots. <br /> <br />- A covenant stating that "4 units in 40 acre" development <br />restrictions shall apply to the land until such time that a <br />higher density development ispermitted by ordinance. <br /> <br />- In the city's designated Rural Area only, a covenant stating <br />that the area is rural and that commercial agriculture and <br /> <br />other rural land use activities will likely be occurring in the <br />area. Complaints relating to these activities shall be <br />considered unwarranted so long as such activities are being <br />conducted in a lawful manner in accordance with existing <br /> <br />standards. <br /> <br />17 <br /> <br /> <br />
