<br /> 110.038 ImpaundmenL All dogs picked up bY
<br /> the Animal C~ntrol Officer or any of his duly-
<br /> authorized assistants shall be irqmediately
<br /> transported to the designated pound. It the
<br /> owner is ~nown, he shall be immediately
<br /> notified by telephone or personal contact and,by
<br /> written notice to his last known address. If the
<br /> owher fs unknown, written notice containing ~
<br /> description of the animal shall be posted at the
<br /> pound and the City Hall. The notice shall advise
<br /> the owner that he has five 15,) regular business
<br /> days fo claim the dog. "Regular business day"
<br /> means any day during which the pound i§ open
<br /> to the public not less than tour (4) consecutive
<br /> hours belween the hours of 8:00 a.m. and 7:00
<br /> p.m.
<br /> ]]0.039 Reclaiming. )kn owner may reclaim an
<br /> impounded dog:
<br /> ]. If the dog has a currenl license, by paying
<br /> to the pound master an impounding tee of $$0.00
<br /> plus a boarding fee in an amount de}ermined by
<br /> agreement between the City and the designated
<br /> pound, for each day the animal was confined.
<br /> The impounding fee for any dog impounded
<br /> twice within ]2 monlhs shall be $]00.00.
<br /> 2. If the dog does not have a current license,
<br /> by first obtaining a license from the City Clerk
<br /> . and paying the above costs to the pound master.

<br /> be unlawful for any person.to molest or in any
<br /> way interfere with any peace Officer, animal

<br /> 1]0.031] Unclaimed Animals. Any animal not
<br /> claimed withi~ the allured time shall be dispbs-
<br /> ed of i~ accordance with the provisions of Min-
<br /> nesota Statutes Section 35.71, Subdivision 3, as
<br /> amended.
<br /> 110.0312 Report of Dog Bites. Any person
<br /> knowing of a human being bitten by a dog shall
<br /> immediately notify the Animal Control Officer
<br /> or the Poll~e Department and said dog shall
<br /> then be confined and kept under observation for
<br /> a period of 14 days before being disposed, of,' if
<br /> necessary.
<br /> 11.0:0313 Destroying a Dog. It shall be unlawful
<br /> for any person other than the Animal Control
<br /> Officer or a ~olice Officer to kill or destroy any
<br /> dog or animal of the dog kind running al large
<br /> in the City or that has been known to bite a per-
<br /> son within a period of 14 days.
<br /> 110.0314 Abandonment. No person shall aban-
<br /> don Or release any dog, cat, or other animal
<br /> within the boundaries of the City of Ramsay.
<br /> 110.0315 Dangerous Dogs.
<br /> · Sued. 1. No person Owning or harboring or
<br /> having the care or custody of a dangerous dog
<br /> shall suffer or pel~mit such dog to go unconfined
<br /> on the premises of such person. A dangerous
<br /> dog is "unconfined" as the term is used in this
<br /> section if such dog is not securely c.onfined in-
<br /> doors br confined in a securely enclosed and
<br /> locked pen or a dog run area upon the premises .

<br /> ]10.03 DOG REGULATIONS
<br /> 110.031 Definitions:
<br /> '~'. "Do~" shall mean any male or female of
<br /> an~ breed of domesticated dog.
<br /> 15..:'Dangerous Dog" shall mean and include:
<br /> 1.. Any dog with a known propensity, tendency
<br /> or disposition to attack unorovoked, to cause in-
<br /> iury or to otherwise endanger the' safety of
<br /> humi~i~ beings or domestic animals; or
<br /> 2.j~ny-dog which attacks a human being or
<br /> domes_tic, animal without provocation; or
<br /> 3. Any dog owned or harbored primarily or in
<br /> part'for the purpose of dog fighting or any dog
<br /> fro ned.for dog fighting.
<br /> c.'?'Owner" shall mean the license holder or
<br /> any:o~h_er person or persons, firm, association,
<br /> or c:~rpoi'ation owning, keeping or harboring a
<br /> dog.'Ao, y person keeping or harboring a dog for
<br /> five.(5) consecbtive da~,s §hall, for the purposes
<br /> of thi~ ch~p~'~Er,'be (teemed an owner thereof.
<br /> ct "Running at large" shall mean any dog
<br /> which is not ei:t~er:
<br /> 1. Effectiv~!y contained on private property;
<br />
<br /> 2. Effectively restrained, by chain 9r leash, to
<br /> private property with the consent of the proper.
<br />
<br /> 3. Effectively restrained by a chain or leash
<br />
<br /> j ceed si_x'(6) feet in length; oK '
<br /> er the voice control of its owner.
<br /> · Vj~ Licensing. All dogs kept, harborbd, or
<br /> mai.ntained, in' the City of Ramsay shall be
<br /> I censed~ ~,.ancl 'regi{tered. Applications for
<br /> licenses shall be made to 1he City Clerk upon
<br /> forms pr0vi~ed by lhe Clerk Said application
<br /> shall require the owner, among other'informa-
<br /> tion required by the City Clerk, to supply the
<br /> name, ag~, predominant breed, sex, color and
<br /> markings of each dog sought to be, licensed. In
<br /> addition, when the ~l~plicaQt o1~ ~wner has bden
<br /> convicted'of violation of Section 110.0315 reid-
<br /> live to the dog sought to be licensed, fha ap-
<br /> plication shall ~equire p~oof of public liability
<br /> insurance i~ the' minimu'm amount of $300,000.
<br /> Upon'su~bmissiohof the applicMio!~ and a certif-
<br /> icate;~videncing compliance with the terms and
<br /> progJ§i~0ns' of 'Cty Cod~ $l~:t'io'n 110.0314,
<br /> rel~Tirlg :td'.vacc~nahon for rabies, and upon
<br /> paymenLotc a fee of $5.00~ .the City Clerk shall
<br /> issue a license, which license shall be eff(~ctive
<br /> until the next 31st day of December of an even
<br /> nuj~ibered year. '
<br /> f,~0.033 Tags. The license shall be in the form
<br /> o} 'an idenlifJcatlbn, tag and seal! be affixed by
<br /> the owner 'to a collar to be'wcrn by-the dog. In
<br /> ca.~e a tag is lost or destroyed/a duplicate will
<br /> b..~'i~s~d by the Cit~ Clerk upon presentation
<br /> ufa r~ceipt showing pay menl of the license fee
<br /> f~';'lhi~ cOrrent p(~riod and pa~:nent of $2.~0 for
<br /> siJCh ~luplicate. Dog tags .shall not be trans-
<br /> feYrable from one dogto another and no refunds
<br /> shall be made on any dog license fee because of
<br /> death of the dog or the owners leaving the City
<br /> prior to expiration of the license period.
<br /> 110.034 Rabies Vaccination. Every owner or
<br /> keeper of ad_dg shall.cause the same to be vao
<br /> cinated by. a licensed veterinary wilh an-
<br /> ti-rabies vaccine at 'least once in every 24-
<br /> month period and pr;lot to the time such dog
<br />each the'age of six (6) months.
<br />35..Running at Large. Every owner or
<br />/.~ of!al dog shall cause the same to be
<br />under th'e'control of and in cu~,tody of ~ person
<br />of sufficient, a.(le to adequately control the dog
<br />at all times, while the dog is off the premises of
<br />the owner. "Control" and "custody" shall mean
<br />on a leash Of not more than six (6) feet in
<br />length. It shall be lawful to have a'dog in an
<br />automobile.without a leash, b.ut it must be on a

<br /> 110.036"'Animal Control-Officer, There is
<br /> hereby established the position of Animal Con-
<br /> trol Officer. He shall Pe appointed by the City
<br /> Council. Nothing contained herein shall prevent
<br /> the City Cpuncil from contracting with a person
<br /> to provide such services.
<br /> 110.037 Duties of Animal Control Drifter. The
<br /> Animal Control Officer shall perform the.follow-
<br /> lng duties:
<br /> 1. Capture, seize and deliver to any desig.
<br /> noted pound any dog found; running at large
<br /> within the City; unlicensed; or not wearing the
<br />~li~t~l tag provided for in this chapter.
<br />ick and dispose of the carcasses
<br /> ~dead animal.

<br />
<br /> Subd. 4. No person shall possess with intent to
<br /> sell, or offe( for sale, breed, or buy or attempt
<br /> to buy within the city any dangerous dog.
<br /> r Sued. 5. in the event that a police officer or
<br /> animal control officer has probable cause to be-
<br /> lieve that a dangerous dog is being harbored or
<br /> cared for in violation of SubSections (1), (2),
<br /> (3), and (4) above, the police officer or animal
<br /> .control officer may petition' a court of compe-
<br /> tent jurisdiction to order the seizure and im-
<br /> poundment of the dangerous dog pending trial.
<br /> In the event that a police officer or animal control
<br /> officer has probable cause to believe that a
<br /> Dangerous dog is being harbored or housed in
<br /> violation of Section (3) above, the police officer
<br /> or animal control officer may seize and ira-
<br /> pound the dangerous dog pending trial.
<br /> 110.0316 Failure te Restrain an attack by'aa
<br /> Dog, It shall be unlawfu for an owner to fail to
<br /> restrain a dog from inflicting or attempting to
<br /> inflict bodily injury to any person or other
<br /> animal. Violation of this section sh,all be a
<br /> misdemeanor. The Court upon a finding of the
<br /> defendant's guilt hereunder, is authorizeP to
<br /> order, as part of the disposition of the case, that
<br /> the animal be destroyed based on a written
<br /> order containing one or more of the following
<br /> findings of fact:
<br /> 1. The animal is dangerous as demonstrated
<br /> by a vicious attack, an unprovoked attack, an
<br /> attack without warning, or multiple attacks; or
<br /> 2. The owner.of the animal has demonstrated
<br /> an inability or unwillingness to control the
<br /> animal in order to prevent injury to persons or
<br /> other animals.
<br /> If the Court does not order the destruction of
<br /> the dog, the Court, as an alternative, may order
<br /> the defendant to orovide, and show proof to the
<br /> Court of public liability insurance in the mini-
<br /> mum a mount of S300,000.00.
<br /> 110.0317 Stopping an Attack. If a~y Police Of-
<br /> ficer or Animal, Control Officer is witness to an
<br /> attack by a dog upon a person or another
<br /> animal, the officer may take whatever' means
<br /> he or she deems appropriate to bring the attack
<br /> to an end and prevent further injury to the ~,ic-
<br /> tim.
<br /> 110.0318 Dogs Disturbing the Peace. It shall
<br /> be unlawful for any person to own, keep, have
<br /> in possession, or harbor any dog which howls,
<br /> yelps, or barks to the reasonable annoyance of
<br /> another person or persons. Any person violating
<br /> this section, who upon first requested by a
<br /> Police Officer or Animal Control Officer to stop
<br /> or prevent the annoyance, and refuses to comp-
<br /> ly with the request will be issued a citation or
<br /> arrested in accordance with Minnesota Rules of
<br /> Criminal Procedure, and; it the officer deems
<br /> it necessary to stop the annoyance, may have
<br /> the dog taken to the City animal pound. Any dog
<br /> placed in lhe pound may be reclaimed by the
<br /> owner upon payment of the fee prescribed i0
<br /> Section 110.039, and if not reclaimed may be
<br /> disposed of in the m.anner .provided'in Section
<br /> 110.0311.
<br /> - 110.0319 Removal of Excrement. It is unlawful
<br /> for any person who owns or ~as custody of a
<br /> dog to cause or permit such animal to defecate
<br /> on any private property without the consent of
<br /> the property owner or on any public property
<br /> unless such person immediately removes the
<br /> excrement and places it in a proper receptacle.
<br /> The provisions of this Section shall not apply to
<br /> seeing-eye dogs under the control of a blind
<br /> person or dogs while being used in City Police
<br /> activity.
<br /> SECTION 2. REPEAL
<br /> Chapter 110.03 of the Ramsey City Code is
<br /> hereby repealed and is replaced by the Chapter
<br /> 1]0.03 langu@~e provided for within this Ordi-
<br /> nance.
<br /> SECTION 3. PENALTY
<br /> Any person violating any provisions of this
<br /> ordinance, with the exception of Section 110.035,
<br /> is guilty of a misdemeanor and upon conviction
<br /> shall be punished by a fine of not more than
<br /> $700.00 or imprisonment for not more than nine-
<br /> ty (90) days or both
<br /> SECTION 4. EFFECTIVE DATE
<br /> This ordinance becomes effective upon its
<br /> passage an~d thirty (30) days after its publica-
<br /> tion according to law~ subject-to,City.Charter
<br /> Provision, Section 5.04.
