It the owner is ~nown, he shall be immediately notified by telephone or personal contact and,by written notice to his last known address. If the owher fs unknown, written notice containing ~ description of the animal shall be posted at the pound and the City Hall. The notice shall advise the owner that he has five 15,) regular business days fo claim the dog. "Do~" shall mean any male or female of an~ breed of domesticated dog. 15..:'Dangerous Dog" shall mean and include: 1.. Any dog with a known propensity, tendency or disposition to attack unorovoked, to cause in- iury or to otherwise endanger the' safety of humi~i~ beings or domestic animals; or 2.j~ny-dog which attacks a human being or domes_tic, animal without provocation; or 3. Any dog owned or harbored primarily or in part'for the purpose of dog fighting or any dog fro ned.for dog fighting. c.'?'Owner" shall mean the license holder or any:o~h_er person or persons, firm, association, or c:~rpoi'ation owning, keeping or harboring a dog.'Ao, y person keeping or harboring a dog for five.(5) consecbtive da~,s §hall, for the purposes of thi~ ch~p~'~Er,'be (teemed an owner thereof. ct "Running at large" shall mean any dog which is not ei:t~er: 1. Dog tags .shall not be trans- feYrable from one dogto another and no refunds shall be made on any dog license fee because of death of the dog or the owners leaving the City prior to expiration of the license period. 110.034 Rabies Vaccination. Every owner or keeper of ad_dg shall.cause the same to be vao cinated by. a licensed veterinary wilh an- ti-rabies vaccine at 'least once in every 24- month period and pr;lot to the time such dog each the'age of six (6) months. 35..Running at Large. Every owner or /.~ of!al dog shall cause the same to be under th'e'control of and in cu~,tody of ~ person of sufficient, a.(le to adequately control the dog at all times, while the dog is off the premises of the owner. He shall Pe appointed by the City Council. Nothing contained herein shall prevent the City Cpuncil from contracting with a person to provide such services. 110.037 Duties of Animal Control Drifter. The Animal Control Officer shall perform the.follow- lng duties: 1. Capture, seize and deliver to any desig. noted pound any dog found; running at large within the City; unlicensed; or not wearing the ~li~t~l tag provided for in this chapter. ick and dispose of the carcasses ~dead animal. No person shall possess with intent to sell, or offe( for sale, breed, or buy or attempt to buy within the city any dangerous dog. r Sued. 5. in the event that a police officer or animal control officer has probable cause to be- lieve that a dangerous dog is being harbored or cared for in violation of SubSections (1), (2), (3), and (4) above, the police officer or animal .control officer may petition' a court of compe- tent jurisdiction to order the seizure and im- poundment of the dangerous dog pending trial. In the event that a police officer or animal control officer has probable cause to believe that a Dangerous dog is being harbored or housed in violation of Section (3) above, the police officer or animal control officer may seize and ira- pound the dangerous dog pending trial. 110.0316 Failure te Restrain an attack by'aa Dog, It shall be unlawfu for an owner to fail to restrain a dog from inflicting or attempting to inflict bodily injury to any person or other animal. Violation of this section sh,all be a misdemeanor. The Court upon a finding of the defendant's guilt hereunder, is authorizeP to order, as part of the disposition of the case, that the animal be destroyed based on a written order containing one or more of the following findings of fact: 1. The animal is dangerous as demonstrated by a vicious attack, an unprovoked attack, an attack without warning, or multiple attacks; or 2. The owner.of the animal has demonstrated an inability or unwillingness to control the animal in order to prevent injury to persons or other animals. If the Court does not order the destruction of the dog, the Court, as an alternative, may order the defendant to orovide, and show proof to the Court of public liability insurance in the mini- mum a mount of S300,000.00. 110.0317 Stopping an Attack. If a~y Police Of- ficer or Animal, Control Officer is witness to an attack by a dog upon a person or another animal, the officer may take whatever' means he or she deems appropriate to bring the attack to an end and prevent further injury to the ~,ic- tim. 110.0318 Dogs Disturbing the Peace. It shall be unlawful for any person to own, keep, have in possession, or harbor any dog which howls, yelps, or barks to the reasonable annoyance of another person or persons. Any person violating this section, who upon first requested by a Police Officer or Animal Control Officer to stop or prevent the annoyance, and refuses to comp- ly with the request will be issued a citation or arrested in accordance with Minnesota Rules of Criminal Procedure, and; it the officer deems it necessary to stop the annoyance, may have the dog taken to the City animal pound. Any dog placed in lhe pound may be reclaimed by the owner upon payment of the fee prescribed i0 Section 110.039, and if not reclaimed may be disposed of in the m.anner .provided'in Section 110.0311. - 110.0319 Removal of Excrement. It is unlawful for any person who owns or ~as custody of a dog to cause or permit such animal to defecate on any private property without the consent of the property owner or on any public property unless such person immediately removes the excrement and places it in a proper receptacle. The provisions of this Section shall not apply to seeing-eye dogs under the control of a blind person or dogs while being used in City Police activity. SECTION 2. REPEAL Chapter 110.03 of the Ramsey City Code is hereby repealed and is replaced by the Chapter 1]0.03 langu@~e provided for within this Ordi- nance. SECTION 3. PENALTY Any person violating any provisions of this ordinance, with the exception of Section 110.035, is guilty of a misdemeanor and upon conviction shall be punished by a fine of not more than $700.00 or imprisonment for not more than nine- ty (90) days or both SECTION 4. EFFECTIVE DATE This ordinance becomes effective upon its passage an~d thirty (30) days after its publica- tion according to law~ subject-to,City.Charter Provision, Section 5.04.
