170.063 CASH PAYMENT <br /> <br />In lieu of public land dedication for the purposes of parks, <br />playgrounds, trails and/or open space as above described, <br />the city Council may require the subdivider to contribute <br />ten percent (10%) of the fair market value of the <br />undeveloped land which value is to be determined no later <br />than final plat approval or Five Hundred Dollars ($500.00) <br />per dwelling unit created, whichever amount is greater. The <br />fair market value of the undeveloped land shall be <br />determined by the tax assessments, records and formulas that <br />apply thereto. The cash payments received as a result of <br />this provision shall be placed in a special fund by the City <br />and used only for acquisition of land for parks, <br />playgrounds, public open space, trails and storm water <br />holding areas or ponds, development of existing parks and <br />playground sites, public open spaces and storm water holding <br />areas or ponds and debt retirement in connection with land <br />previously acquired for such public purposes. <br /> <br />170.064 COMBINATION OF LAND DEDICATION AND CASH PAYMENT <br /> <br />In appropriate plats, a combination of land and cash may be <br />required by the city. <br /> <br />170.065 SCENIC EASEMENT <br /> <br />In appropriate plats, as determined by agreement between the <br />City Council and the subdivider, the subdivider may dedicate <br />to the public a scenic easement in combination with the <br />requirements of Sections 170.062 and 170.063 above or, if <br />the subdivider and City Council agree, the scenic easement <br />dedication may be in lieu of the requirements in Sections <br />170.062 and 170.063 above. <br /> <br />170.066 AGREEMENT AS TO DEDICATION <br /> <br />Agreements as to the requirements in Sections 170.061 <br />through 170.064' above shall be made prior to preliminary <br />plat approval. Failure of the City Council and subdivider <br />to reach agreement regarding the matters in Sections 170.061 <br />through 170.064 above shall constitute denial of the <br />preliminary plat. <br /> <br />SECTION 2. REPEAL <br /> <br />Section 170.06 of the Ramsey City Council entitled <br />Dedication of Parks and Open Spaces adopted by Ordinance 83- <br />13 is hereby repealed only to the extent that it is not <br />applicable to subdivisions filed with the city for approval <br />after the effective date of this Ordinance.
