<br /> CHAP. TER OF THE CITY CODE OF RAMSEY,
<br /> MINNESOTA.
<br /> AN ORDINANCE AMENDING CHAPTER 1'30
<br /> OF THE BUSINESS AND TRADE CHAPTER
<br /> OF THE RAMSEY CITY CODE BY THE AD-
<br /> DITION OF SECTION 130.12 ENTITLED
<br /> "CHARITABL~E GAMBLING".
<br /> . The City of Ramsay ordains:
<br /> SECTION 1. AMENDMENT.
<br /> 130.121. In general. Lawful gambling con.
<br /> ducted pursuant to Minnesota Statutes, Chapter
<br /> 349 shall be operated In accordance with the
<br /> conditions prescribed in this chapter and other
<br /> applicable provisions of the Ramsay City Ordl.
<br /> nance. ·
<br /> i30,122. Notlcei approval or disapproval. The
<br /> applicant for a gambling license shall notify the
<br /> City Council in writing In the manner required
<br /> by law of each pending application for a
<br /> charitable gambling license at least sixty (60)
<br /> days before Issuing or renewing the license.
<br /> Each pending application for a license shall be
<br /> approved or disapproved by the City Council.
<br /> 130.123. Location. Lawful gambling under
<br /> license Issued by the Minnesota Charitable
<br /> Gambling Control Board may be conducted only
<br /> at locations that comply with applicable zoning,
<br /> building, fire, and health codes of the City of
<br /> Ramsay. All applications must be for a specific
<br /> Jocatl(~n with the exception of Class D (raffle
<br /> only) licenses.
<br /> The following locations are considered un.
<br /> suitable for gambling operations and any re-
<br /> lambllng license at such a location
<br /> be rejected without clear and convincing
<br /> that such a location will not pose un-
<br /> due, enforcement difficulties, lessen property
<br /> values of adjoining properties, or expose gambl-
<br /> lng to persons un'der eighteen (18) years of age:
<br /> (a) Areas zoned for agriculture or residential
<br /> use;
<br /> (b) Locations where the predominant
<br /> clle?tele Is under the age of eighteen (18) years
<br /> ofaga~
<br /> '130.124, Conditions. The' conduct of lawful
<br />· ga.mbllng under license Issued by the Minnesota
<br />[' Charitable Gambling Control Board shall be
<br />L sublect-to the following conditions In the City of
<br />Ramsay:
<br /> (a) No Organization shall be eligible for a
<br /> g~mbll~g license unless, for the three (3) years
<br />"Inlmediately preceding the date of application,
<br /> it hag d~monstrated that during that period It
<br /> has performed substantial charitable services.
<br /> .' (b). NO more than two (2) bingo occasions
<br />each week, shall be conducted by any organiza-
<br />tion. No parson who leases premises to two (2)
<br />or more'~organlzatlons for purposes Including
<br />r the'i:6nd..u~t of bingo shall'allow more than two
<br />~ :(2)' b~lngo'occaslons to be conducted on the
<br />, "preml~s Ih-any Week~
<br />''~ !/(C)L Ga:mb'ling locations shall be limited to one
<br />~ (1).ll,c. elr~Se,cl gambling organlzatlon at any one
<br />·. time In:the licensed premises and any rooms
<br />{?-a~dlOlnlng }h~ premises under the same
<br />"m.ana~m&nt. No lease shall be made with one
<br />i organization while another lease is In effect for
<br />~ ,'E-tke sa~e, or~4ale establishment;
<br />: :' ,(d). Evel*y agreement between a non.profit
<br />~' :organl~atl0n and a gambling location owner for
<br />~.. gambllilg"'~hall be In the form of a written lease.
<br />~ ~'J'he'wrltten:lease shall be the complete agree-
<br />~' m~nt 6e-tWaan the,parties, and there shall be,no
<br />', un~gitten'te~;ms or conditions. The lease shall
<br /> · specifically provide that the essee shall operate.

<br />I ·non-profit organization and a gambling
<br /> location

<br />! [f?{~). A lease agreement belween a non,profit.
<br />~':':'o~ganlzatlon and a gambling location, owner or
<br />: ..'ol~erato~ shall not pi'ovlde for rental payments
<br /> based on a percentage of receipts or profits
<br /> from lawful gambling. There shall be no other
<br /> compensation paid fo the gambling location
<br /> owner or operator, directly or Indirectly, other
<br /> than the rental fee provided in the lease agree-
<br /> ment. The maximum rental fee shall be six
<br /> hundred dollars ($600.00) per month;
<br /> (g) The gambling operations shall be main.
<br /> rained bY the organization licensed to Conduct
<br /> gambling and shall be under the'exclusive con-
<br /> trol of that organization. The organization
<br /> licensed to conduct gambling shall prominently
<br /> dl~p!ay Its' name at the location where the
<br />gambl!ng devices are distributed or used and
<br />h~ll Intricate the Intended use of all profits
<br />rom gambling. .
<br /> (lQ No employees or agents of the gambling
<br /> location shall be paid for handling gambling
<br /> devices, gambling money, pr.lzes or gambling
<br /> records; ,
<br /> (ii '.The m;ganlzatlon licensed to conduct
<br />
<br />gambling shall have exclusive control over all
<br />gambling devices, money, and records.
<br />Whenever the organization is not .present or
<br />specifically represented by ifs agent, all gambl-
<br />lng devices, money, and records shall be
<br />securely locked and shall be inaccessible [o
<br />employees of the gambling location;

<br /> (k) No food, drink, or entertainment di~-
<br />counts or other promotions shall be offered in
<br />conlunction with the sale of gambling devices
<br />
<br /> (I) The gambling location shall allow the
<br />organization to conduct gambling al any time
<br />during its lawful business hours and shall pro-
<br />hibit gambling at any time other than its lawful
<br />business hours;
<br /> (m) The owner or operator of a gambling
<br />location shall make no agreements with any
<br />gambling equipment distributor requiring the'
<br />use of his or her gambling equipment in the
<br />establishment;
<br /> (n) The City Council may disapprove a
<br />gambling license application for an establish-
<br />ment in which gambling violations have
<br />previously occurred.
<br /> 130.125. Investigation. Every organization
<br />Which files an application '~0r .issuance or
<br />renewal of a charitable gambling license shall
<br />deliver the application to the City Ad-
<br />ministrator. The City Administrator shall in-
<br />vestigate each application and report any fin-
<br />dings and recommendations to the City Council.
<br />130.126. Filing of records; inspection; access
<br />
<br /> (a) Every organization licensed to c0nducl
<br />gambling in the City of Ramsay shall file with
<br />the City Administrator copies of ail records and
<br />reports required to be filed with the Minnesota
<br />Charitable Gambling Control Board pursuanl to
<br />Minnesota Statutes, Chapter 349 and the rules
<br />and regulations promulgated thereunder. The
<br />records and reports shall be filed in the office of
<br />the City Administrator at the same time they
<br />are due to the Board;
<br /> (b) Every gambling event in the City Of
<br />Ramsey conducted .by an organization under
<br />Minnesota Statutes, Chapter 349 shall be open to
<br />inspection by officers of the Ramsey Police
<br />Department;
<br /> (c) The City Administrato~ or employees of
<br />the Police Department, at the direction of the
<br />City Administrator, may inspect at any reason-
<br />able time; without notice or search warrant, all
<br />records of a licensed organization, including
<br />gambling account and other bank records re-
<br />quired by the Minnesota Charitable Gambling
<br />Board to be maintained and pr.eserved. '
<br /> 130.127. Fee.
<br /> Upon application, the Cily will charge all new
<br />applidants $400 to cover costs incurred in-
<br />vestigating the application· Any unused portion
<br />of this fee will be refunded to the appiicant.
<br />This fee does not apply to applications for
<br />renewal of license
<br />SECTION 2. SEPARABILIT.Y.
<br /> Should any section or provision of this ordi-
<br />nance be declared by a court of competent
<br />jurisdiction to be invalid, such decision shall not
<br />affect the validity of .the ~ordinance as a whole
<br />or any parts thereof, of her than the parts so
<br />declared to be invalid.
<br />SECTION 3. EFFECTIVE DATE.
<br /> This ordinance becomes effective upon. its
<br />passage and thirty .(30) days after its public.a-
<br />lion according ot laW, subiect to City Charter
<br />Provision, Section 5.04.
