<br /> · SECTION 1. AUTHORITY:
<br />
<br /> · This Ordinance Is enacted pursua,nt to MS
<br /> Section 410.12, Subd. 7.
<br /> '; :SECTION 2. AMENDMENT.
<br /> · Section 13.01. Department Created. A poll~:e
<br /> ':"department for the City shall forthwith be es- '
<br /> tabt shed as permanent and sh,~if coils/st of a
<br /> Chlref of Police and such other officers an~ ';
<br /> niembers as may be pr°vlded for by the Court.

<br /> Section 13.02. Appointments. The Chief of
<br />,' Police shall be appointed by the Council. All
<br /> or,pr appointments to or promotions within the'
<br /> dePa~'tment shall be made as provided by law.
<br /> Section 13.03. Rank. The Chief of Police shall
<br /> be'the head of the deparlment and have suffer-
<br /> vision over all officers and members thereof.
<br /> 'Section 13.04. Duties of Chief. The Chief of'
<br />. ,P?ice shall keeP such records and make such
<br /> ?eports concerning the activities of the police
<br /> departmenl as may be required by Statute or
<br /> :r'"4;~bY the City Council. The Chief shall be
<br />· ';c ~ible'jor the performance by the police depart-
<br /> ment of ils functions~ and all persons who are
<br /> · member~ of the police department shaJl serve
<br /> ?sbblect to the orders of the Chief of Police.
<br /> .... S~ction 13.05. Duties. It shall be the duty of
<br /> I .the officers ~f the police department to see to
<br /> .the enforcement of all Of the ordinances of the
<br /> City and all statutes applicable therein, and to
<br /> · preserve order and prevent infractions of the
<br /> law and arrest violators thereof.
<br /> · Section 13.06. Conduct of Members. It shall be
<br /> the duty of every member and officer of lhe
<br /> police department to'conduct himself or herself
<br /> In a proper an.d law abiding manner at a!l
<br /> times. Each member and officer of the depart-
<br /> ment shall obey the orders and directions of
<br /> his/her'superlor.
<br /> Section 13.07. Rules and Regulati(~ns. The
<br /> Chief of the police department may make or
<br /> prescribe suc~3 rules and regulations as he/she
<br /> shall deem advisable;.such rules, when approv-
<br /> ed by the Council, shall be binding on such of-
<br /> ricers and members. Such rules and regulations
<br /> may cover, besides the conduct of the officers
<br /> .and members, uniforms and equipment to be
<br /> worn or carrled,~hours of service, vacation, and
<br /> all other similar matters necessary o~ desirable
<br /> for the efficiency of the department.
<br /> Section 13.08. Equal Opportunity. In making
<br /> appointments to the police department, no per-
<br /> so~ shall be deprived of an opportunity to serve
<br /> on the police department because of race,
<br /> relfglon, skin color, national origin, or sex. No
<br /> , arbitrary rules on height, weight, or achieve-
<br /> ment of strength unrelated to iDb needs shall be
<br /> imposed; No handicapped person shall be
<br /> ' denie, d,' merely by vlr'tue of being handical~ped;
<br /> appb~,thlent to a position on the police depart-
<br /> ! ment/wh!ch 'the handicapped person is compe-
<br />' tent t~ fifl. ' '
<br /> r SECTIOt~ 3. EFFECTIVE DATE.
<br /> This Ordfflance shall become effective 90 days
<br /> after: its pPssage and'publication subject to the
<br />'. provl,';l~rJ$ OT MS ~10.12, Subd. 7.
