(h) <br /> <br />To permit that conduct prohibited by MSA §617.246, which <br />statute is entitled "Use of Minors in Sexual Performan¢~ <br />Prohibited." Said statute is hereby incorporated by <br />reference as if fully set forth herein. A copy of said <br />statute is on file for use and examination in the office <br />of the City Aministrator. Incorporation of said statute <br />herein is not intended to effect the prosecution of this <br />statute as a felony pursuant to Subdivisions 2 and 3 of <br />said MSA §617.246. <br /> <br />SECTION 2. PENALTY: <br /> <br /> A violation of any portion of this Ordinance shall be <br />considered a misdemeanor punishable by imprisonment for up to 90 <br />days and a fine of $700.00, or both, except that a violation of <br />Paragraph H. herein is a felony as provided by MSA §617.246. The <br />licensee, the licensee's employees and/or representatives and the <br />person actually engaging in any of the prohibited acts shall be <br />criminally liable. Any violation of this Ordinance shall also <br />constitute grounds for revocation or suspension of the licensee's <br />license in accordance with the rules and procedures otherwise <br />established by Ordinance 89-3 and applicable state statutes. <br /> <br />SECTION 3.
