do <br /> <br />¥111. <br /> <br />An area where groundwater is contaminated or lies within the path of the <br />migration of contaminated groundwater. <br /> <br />Required Practices for Maintenance and Operation of Industrial Solid Waste Land <br />Disposal Facilities. <br /> <br />Any person who maintains or operates an industrial solid waste land disposal <br />facility or permits the use of property for such a facility, must maintain and operate <br />the facility in conformance with the following practices unless otherwise allowed by <br />the City in issuing the conditional use permit: <br /> <br />i. Open burning is prohibited. <br /> <br />ii. <br /> <br />Industrial solid waste must not be deposited in a manner that allows material <br />or leachings therefrom to cause pollution of ground water or surface water. <br /> <br />Proposed separation between the lowest portion of the facility and the high <br />water table elevation must be a minimum of five feet. This requirement <br />does not render inoperative any other requirements specified herein and <br />additional ground water protection must be provided. <br /> <br />111. <br /> <br />Dumping of industrial solid waste must be limited to as small an area as <br />practicable and with appropriate facilities to confine windblown material <br />within the area. At the conclusion of each day of operation, all wind-blown <br />material resulting from the operation must be collected and returned to the <br />area by the owner or operator. <br /> <br />iv. <br /> <br />Industrial solid waste must be compacted as densely as practicable and <br />covered after each day of operation, or as specified by the commissioner of <br />the MPCA, with a compacted layer of at least six inches of suitable cover <br />material. All previously filled areas must be maintained with at least six <br />inches of suitable cover material. <br /> <br />If disposal areas will be exposed to the elements for a period of 129 days or <br />longer, an intermediate cover totaling at least 12 inches of compacted, <br />suitable cover material must be provided and maintained. <br /> <br />There must be an available supply of suitable cover material, which, if <br />necessary, must be stockpiled and protected to allow for compliance with <br />the requirements contained in item D including during periods of inclement <br />weather or winter operation. <br /> <br />The industrial solid waste land disposal facility must be constructed and <br />cover material graded to promote surface water runoff without excessive <br />erosion. <br /> <br />Vo <br /> <br />Surface water drainage must be diverted around and away from the facility <br />operation area. <br /> <br />vi. <br /> <br />A minimum separation distance of 1000 feet, or greater as specified by the <br />commissioner, must be maintained between the disposal operation and the <br />adjacent property line. <br /> <br />vii. Effective means must be taken if necessary to control flies, rodents, and <br /> <br /> <br />
