<br /> "HORSES".
<br /> The City of Remsey Ordains:
<br /> '5ECTi.0N t. AMENDMENT
<br /> Chapterr. 110.07 of the City Code is hereby amended to read as follows:

<br /> The purpose of this chapter is:
<br /> 1 ) To prohibit the maintaining of horses on lots or oarcels of record less than ].Srecres in size;
<br /> 2) TO require a Conditional Use Permit pcIor to maintaining a horse on a lot of record 1.5 acres in
<br /> size and less than three (3) acres in size;
<br /> 3) To require the filing with the City of a sketch drawing prior to maintaining a horse on a lot or
<br /> parcel of recorded three (3) acres and larger in size; and
<br /> 4) To ensure proper handling, treatmeht and maintenance of horses.
<br /> 110.071 HORSE DEFINED
<br /> As used in this chapter, horse shall mean any stallion, mare, gelding, foal, pony, donkey, ass,
<br /> burro, mule or animal of horse kind.
<br /> 110.72 ACREAGE REQUIREMENTS
<br /> i' The following chart prescribes the number of horses that can be r~aintained on lots of record of

<br /> 110.074 SKETCH DRAWING REQUIRED ·
<br /> 1. PriOr to maintaining and boarding a horse or horses on any parcel of land three (3) acres or more
<br /> in size, the landowner shall provide a sketch drawing to the City.
<br /> 2. Required Sketch Drawing illformatlon shall include':
<br /> a. Name and address of the fee owner of the subject'property where the horse(s) are to be mbin-
<br /> reined and the hame and address of occuPant of said property..
<br /> b. Legal description of subject property.
<br /> c. Acreage of sub eof property and acreage of enclosed roam lng area.
<br /> d. Number of horses to be maintained on subiect property.
<br /> e. Sketch drawing showing, to scale: 1) Lo, alien of all buildings on subject p~oporl~'; 2) fenced in
<br /> horse pasture area; 3) location and distance from subject property of all adjacent property's
<br /> buildings; and 4) area on subject property where rn~nure will be stored if ~he number of horses ex-
<br /> ceeds one horse per 1/2 acre of enclosed roaming area.
<br /> 110.75 RODENT AND INSECT CONTROL
<br /> I. Manure shall be handled or treated in such a manner as not to create a public nuisance which shall
<br /> -'mean at a ~inimum that manure will be properly disposed of weekly when the number of horses on
<br /> any one parcel exceeds one .horse per I/2 acre of enclosed roaming area.
<br /> . 2. Corrals, pens, stables or similar enclosures shall be maintained in a manner to minimize.fly
<br /> breeding.
<br /> 3. Accumulations of horse manure on the paved poi'lion of a st~;eet, sidewalk or alley shall not be
<br /> permitted, and the horse owner shall be responsible to abate such nuisance.
<br /> 110.076 CARE AND MAINTENANCE OF HORSES
<br /> 1. No horse shall be treated cruelly or inhumanely bY any Person or in violation of Minnesota Statutes
<br /> . 346.20-345.26 which provisions relate to preventing cruelty ta animals.
<br /> 2. Proper care and maintenance of each horse shall be the responsibility of the person, ·firm, or
<br /> corporation designated as the owner, caretaker or custodian of such horse.
<br /> 3. No Parson shall keep a horse in a manner creating a public or private nuisance.
<br /> 4. Horses shall be provided adequate shelter.
<br /> 5. Fences for pens, corrals, or similar enclosures must be of sufficient height and strength to retain
<br /> the horse(s) enclosed, Extra care must be taken to insure the stallions are properly enclosed.
<br /> 110.079 CONTROL, TRESPASS PUBLIC ROADWAYS AND IMPOUNDMENT
<br /> 1.' No person, shall permit any'horse of which he/she is the owner, caretaker or custodian to run at
<br /> large wffhln the City. Such animal will be deemed to run at large when it is off the premises owned or
<br /> rented by its owner and unaccompenled by the owner, or an agent or employee of the owner.
<br /> 2. The Chief of Police or any designated agent of the City may Impound any horse found at large and
<br /> shall provide proper sustenance for such impounded horse. The Chief of Poli~e or designated agent
<br />~all, within 24 hours after any such horse has been impounded, post wrlffon notice at the City Hall
<br />j~crlbing such horse and stating that it has been impounded and notify the Horse Care Commlss. ion.
<br />~he owner of the impounded horse is know~ to the. person impounding or Horse Care Commission,
<br /> ."~Eersonal service of notice of such imooundlng shall be served within 24 hours after impounding upon
<br /> such owner in the manner prescribed by State law for the ~ervice or process.
<br /> 3. Costs incurred by the City in impounding horses running at large shell be paid by the owner of the
<br /> horse prior to releasing the horse. An impounded horse shall be released only to a person providing
<br /> proof of ownership and displaying a receipt from the City Clerk shpwing payment of the reasonable
<br /> costs of impounding, cost of feeding end veterinarian care, if required.
<br /> 4. Any person, who without authority of law, end without first paying the costs due, shall take an
<br /> r!mpounded horse Out of the enclosure in which it is !mpounded, shall be guilty of a misdemeanor.
<br /> 5. In the event a horse imPOundedby the City isnot redeemed within fourteen days, after its im-
<br /> poundment, the Chief of Police or designated agent shall give three days notice of the time and place
<br /> where such horse will be sold by posting and serving notices as required for notice herein. If such
<br /> horse cannot be sold on the day stated, t may be so d as soon as possib e thereafter without notice.
<br /> The City Administrator shall turn over the proceeds of all horse sales and impounding fees to t~e
<br /> Treasurer. On order of the City Council, the City Treasurer shall pay to the owner of an Im-
<br /> the difference'belween the sa e pr ce, and the cost of impounding, feedipg and
<br /> s charges, if the previous owner of the horse sold makes claim for the proceeds of the sale within
<br /> one (1) year from the date of sale, otherwise, the sale proceeds shall be forfeited to the City.
<br /> 7. NO person may ride or drive a horse after sunset and before sunrise along or crossing any public
<br /> or reflectorized clothing. -. - . . . , ,...-----
<br /> 8. The City counc shall d~slgnate, and properly post those areas in public lands and parks where
<br /> horses may be ridden
<br /> 9. NO perse~ may ride or drive a horse in any public pa'rk, beech, golf course or other public property
<br /> except Within the right-of-way of public streets and highways end areas duly desigated by the city as a
<br /> trail or hitching area. ' ·
<br /> 10. Persons ridlng horses or driving a horse-drawn vehicle~Jp0rl a public road way shall be subject to
<br /> those provisions of the City code and State Law applicable to the driver of motor vehicles, except
<br /> those provisions which by their nature have no application, r
<br /> 11~ Horses shall not be ridden in any manner wh ch wo01d ca,se undue damage to any hard-surfaced
<br /> road.
<br /> · 12. No person shall ride or drive a horse upon private property without the prior written permission
<br /> of the owner or occupant thereof .
<br /> · 13. No per.son shall interfere with any horse ridden or kept in a lawful manner, and owners of
<br /> domestic animals shall restrain their animal so as not to interfere.
<br /> 110.078 HORSE CARE C0MMI5SION
<br /> 1. The City Council hereby authorizes the establishment of a Horse Care Commission to assist the
<br /> Cbmmunity'Deve opmen~' Department in resolving complaints from those persons aggrieved by
<br /> horses, to investigate ;0mplalnts, to advise horse owners against whom complaints have been lodged
<br /> and to recommend to the City Council approprlate, action
<br /> 2~ The. City Counci! shall appoint five (5) persons to the Horse Care Commission, including when
<br /> possible e representat Ye of the largest horse-oriented association or clt~b within the City and any
<br /> .other parson who the City Council feels is qualified to serve. Two (2) members shall'serve a three (3)
<br /> .year term, two (2) members shall ee~ve a two (2) year term, and (1) member shall serve a one (1)
<br /> year term. Any member is eligible for reeppointment, at the end of his/her term. At least four-fifths
<br /> (4/5) of the Horse Care Commission shall be. residents Of the City of Ramsey.
<br /> 3. The Horse Care Commission shall be a Commission of the City end as such shall be required to
<br /> keep min0tes of its meetings and comply with the open meeting laws of. the State of Minnesota. The
<br /> Horse Care Commission shall be advisory only to the City Council and the Commission is not em-
<br /> independent authority to take final action on any of the duties assigned to it herein
<br /> SECTION 2. PENALTY . .
<br /> Any person convicted of a violation of any of the provisions of this ordinance shall be punished by a
<br /> fine of not more than Seven Hundred Dolla[s ($700.00) or by imprisonment for a period of not more
<br /> than ninety (90) days, or both. Each day a violation is permitted to exist, shall constitute e separate
<br /> offense.
<br /> ~g.~iolation of the Ordinance may be enloined by the City Council through proper legal channels.
<br /> / l 3. EFFECTIVE DATE
<br /> ~-~F~rdinance becomes effective upon its passage and thirty (30) days after its publication ec-
<br /> coll~l~'g to law, subject to City Charter Provision, Section 5.04.
