IS KNOWN AS THE "COUNCIL, <br />'iOARDS AND COMMISSIONS" CFiAP- <br />R OF.THE CITY CODE. <br />. AN ORDINANCE AMENDING SEC- <br />TION 2.01.02 OF THE CITY CODE, <br />WHICH SECTION IS ENTITLED "PRESID- <br />ING OFFICER." <br />The City of Ramsey Ordains: <br />SECTION 1. AMENDMENT • <br />:Section 2.01.02, entitled "Presiding' <br />i ,Officer" of Chapter.2 of the City .Code is <br />5 replaced by the following text: . , <br />2.01.02 Presiding Officer. <br />Subdivision 1. Mayor as Presiding <br />Officer. The mayor shall preside at all <br />meetings of the council, In the absence <br />of the mayor, the acting mayor shall pre - <br />side. In the absence of both, the City <br />Administrator shall call the meeting to <br />order and shall preside until the council <br />members present at the meeting choose <br />. one of their number to act temporarily as <br />presiding officer, <br />Subdivision 2. Presiding Officer <br />Duties. The presiding officer shall pre- <br />; serve order, enforce the rules of proce- <br />■ dure herein prescribed, and determine <br />without debate, subject to the final deci- <br />sion of the Council on appeal, all ques- <br />tions of procedure and order, Except as <br />otherwise provided by statute or by these <br />rules, the proceedings of the council shall <br />be conducted •in accordance with <br />Robert's Rules of-Order Revised. All ques- <br />t tions and remarks shall be addressed to <br />the presiding officer, or through the pre - <br />siding.officer to the. appropriate Council <br />Member, staff member, citizen or other <br />appropriate person. <br />Subdivision 3. Appeal of Presiding <br />ricer Ruling. Any member may appeal <br />the council from a ruling of the presid- <br />ing officer. The member appealing shall <br />clearly ,state- the reasons for his /her <br />appeal. If the appeal- is .seconded, the <br />presiding officer may explain his /her rul- <br />ing, but no other council rnember shall <br />participate in the discussion. The appeal <br />shall be sustained if it is approved by -the <br />majority of the members present, exclu- <br />siv,,e.of the presiding officer. • • <br />Subdivision' ,4. Presiding Officer <br />Participation. : The mayor or such other <br />members :of. the council as may be pre- <br />: siding, may move, second and debate <br />from the Presiding Officer. The presiding <br />officer shall not be deprived of any of the <br />privileges of a council member by reason <br />• of acting as. presiding officer. <br />Subdivision 5. Decorum and Order — <br />i Council Members ■ • • <br />a. Any Council Member desir- <br />ing to speak shall. address the <br />presiding Officer and, upon recogni- <br />tion, shall confine himself or herself <br />to the question under debate: <br />b. ,A ;Council. Member who <br />-;• .wishes •to question, a staff member <br />shall address the question to the City <br />Administrator through the Presiding <br />Officer. The City Administrator shall <br />be entitled to either answer the <br />inquiry or designate a member of the <br />staff to answer. <br />c. A Council Member who <br />wishes to ask a question of the City <br />Attorney may do so alter being rec- <br />ognized by the Presiding Officer. <br />d. A Council Member, once <br />recognized, shall not be interrupted <br />while speaking unless called to order <br />by the Presiding Officer, unless a <br />point of order is raided by another <br />Council Member, or unless the speak- <br />er chooses to yield to questions from <br />another Council Member <br />e. Any Council Member <br />called to order while speaking shall <br />cease speaking immediately until the <br />question of order is determined. If <br />ruled to be in order, he or she shall be <br />permitted to proceed. If ruled to be <br />•• not in order, he or she shall remain <br />silent or shall alter his or her remarks <br />so as tb comply with the rules of the <br />Council. <br />f. Council Members shall <br />accord the utmost courtesy toward <br />,rich ptber I to Cjty. njployees <br />.citizens, appearing before the <br />Council. Council Member . shall <br />refrain at all times from rude and <br />derogatory remarks, reflections about <br />integrity, abusive comment and <br />statements regarding motives and <br />personalities. <br />g. Any Council Member may <br />move to require the Presiding Officer <br />to enforce the rules and the affirma- <br />tive vote of a majority of the Council' <br />shall require the Presiding Officer to <br />'so act. <br />h. Any Council Member may <br />address the Council on a question of <br />personal privilege if his or her integri- <br />ty, character or motives has been <br />assailed, questioned or impugned. . <br />i. No Council Member should <br />speak more than once on any one <br />subject until every other Council <br />Member choosing to speak on the <br />topic has spoken. <br />j. Any Council Member shall <br />have the right to express dissent from <br />or protest any action of the Council <br />and have the reason entered into the <br />minutes. If such dissent or protest is <br />desired to be entered in the minutes, <br />this should be made clear by lan- <br />guage such as "I would like the min - <br />utes to show that I am opposed to <br />this action for the following reason:" <br />Subdivision 6. Decorum and Order — <br />Employees: Members of the City staff <br />shall observe the same rules of procedure <br />and decorum applicable to members of <br />the council. The City Administrator shall <br />ensure that all City staff observe such <br />decorum. Any Staff member; including <br />the City Administrator, who desires to <br />address the Council or members of pub- <br />lic shall first be recognized, by the <br />Presiding Officer. All remarks. shall .be <br />addressed to Presiding Officer or through <br />the Presiding Officer to an individual <br />Council Member or member of the pub- <br />lic. <br />Subdivision 7. Decorum and Order — <br />Public: Members of the public attending <br />Council meetings shall observe the same <br />rules of order and decorum applicable to <br />the Council Members. Any person mak- <br />ing inappropriate remarks or who - <br />becomes boisterous while addressing the <br />Council shall be removed from the room <br />if the Sergeant -of -Arms is so.directed by <br />the Presiding Officer. <br />Subdivision 8. Enforcement of <br />Decorum: The Chief of Police shall be the <br />ex- officio Sergeant -of -Arms of the <br />Council. He /she shall carry out all orders <br />and instructions given by the Presiding <br />Officer for the purpose of maintaining <br />order and decorum in the Council <br />Chambers. Upon instructions from the <br />Presiding Officer, it shall be the duty of <br />.the Chief of Police or representative to <br />eject. any person from the Council <br />Chambers. <br />SECTION 2. REPEAL <br />Section 2.01.02 of Chapter 2 entitled <br />"Presiding Officer" of 'Chapter 2 of the <br />City Code is hereby repealed. - <br />SECTION 3. EFFECTIVE DATE <br />This' Ordinance becomes effective <br />upon its passage and thirty (30) clays <br />after its publication according to law, <br />subject to City,Chapter Provision, Section <br />5.04. • <br />PASSED by the City Council of the <br />City of Ramsey, Minnesota, the 25th day <br />of lune 2002. <br />Thomas G.
