SUBD.3 ~IOUNT OF FEE 3.a. During the period of November 1, 1990 through August 31, 1991, the disposal facility operator may apply to the City on a calendar month basis for a tipping fee reimbursement. The application will provide a daily report of tonnage of waste deposited in the landfill during the subject month. The City will, within 30 days after receipt of the application, reimburse to the facility operator, 60% of the subject month's tipping fee previously paid to the City IF the total tonnage of landfill waste received at the facility during the subject month averages at least 185 tons per day for each day the landfill is open, Monday through Friday and one- half (½) day on Saturdays, exclusive of legal holidays and facility closing because of extreme weather conditions. The tipping fee presently charged is $1.00 per cubic yard or its equivalent of solid waste deposited. This amount is pursuant to that authority granted the City by MSA §115A.921. If the operator qualifies for the reimbursement for a particular month, the actual tipping fee will be $0.40 (40¢) per cubic yard or its equivalent of solid waste deposited and the City will reimburse to the operator $0.60 (60¢) per cubic yard or its equivalent of solid waste deposited. This reimbursement provision is contingent on the facility operator reducing the fee it charges to its customers in an amount at least equal to the tipping fee reduction being applied for. The reduction will be measured by comparing the rate charged landfill customers on September 1, 1990, as compared to the rate charged during the subject month. SECTION 3. EFFECTIVE DATE. This Ordinance becomes effective upon its passage and thirty (30) days after its publication according to law, subject to City Charter Provision Section 5.04. 2
