ANOKA COUNTY, MI NN ESOTA.,, AN ORDINANCE AMENDING 130.102 KNOWN AS THE "SOLID WASTE POSITING FEE" CHAPTER OF THE CITY CODE. The City of Ramsay ordains: SECTION I. PURPOSE. WHEREAS, the City Council hereby finds th~t closure at the earliest possible date of the ed municipal solid waste landfill, known as the AnDRe Regional Landfill, le~at~l within the City, is In the best Interests ~ ~ · health, safety and general welfare of fha dents of the City of Ramsey; and ' WHEREAS, the depositing of fill Into landfill at a faster rate will hasten clos~re"o~ fha landfill; and WHEREAS, the operator of the landflll'"'dl~ requested that the City reduce by ~1% the fi~- lng fee collected by the City for each ton of fill deposited at 'the landfill In order to reduce the charge to landfill customers In order that the landfill be more competitive and obtain waste volume at a faster rate; and WHEREAS, the landfill operator has repre. sunred to the City Council, that the City's tipp- Ing fee reduction along with a fee reduction by both Anoka County end the operator will cause the landfill to become more competitive, obtain waste volume at a faster rate and thereby reach the landfill's capacity in a shorter period of time than would otherwise be reached; and WHEREAS, the landfill operator has relate. sunred to the City Council that a 60% tipping fee reduction by the City will attract an additional Ons per day average of waste, over .e~d tP' ',rese,'l}8$ tens per day average, · , I~E'~i~RE~,It is for the purposes stated above that the City Council adopts this ordl, SECTION 2..AMENDMENT. Subsection 3 of Sectior~ 130.102 of the Ramsay · City Code Is amended by the addition of Subsec- tion 3A which provides as follows: SUBD. 3 AMOUNT OF FEE 3.a. During the period of November 1, 1990 through August 31, 1991, the disposal facility operator may apply to the City on a calendar month basis for a tipping fee reimbursement. The application will provide a daily report of · tonnage of waste deposited in the landfill during the subiect month. The City will, within 30 days after receipt of the application, reimburse.to the facility operator, 60% of the subject month's tipping fee previously paid to the City IF the total tonnage of landfill waste received at the facility during the subject month averages at last 185 tons per day for each day the landfill Is open, Monday through Friday and one-half day on Saturdays, exclusive of legal hollclays and facility closing because of extreme weather conditions. The tipping fee presently charged is $1.00 per cubic yard or its equivalent of solid waste de- posited. This amount is pursuant to that authority granted the City by MSA §115A.921. If the operator qualifies for the reimbursement for a particular month, the actual tipping fee will be $0.40 (40¢} per cubic yard or Its equivalent of solid waste deposited and the City will reimburse to fha operator $0.60 (60¢) per cubic yard or its equivalent of solid waste de- posited. SECTION :3. EFFECTIVE DATE. This Ordinance becomes effective upon its passage and thirty (30) days after its publica- tion according to law, subject to City Charter Provision Section 5.04.
