then approval for such an expansion, development or <br />redevelopment may be requested as a conditional use as <br />regulated by §9.03.04 of this Chapter. <br /> <br />Non-conforming buildings, structures and/or uses, which based <br />upon documented study and evidence, pose a danger and/or <br />threat to the health, safety, and general welfare of the <br />community, shall: Upon being identified by the City and upon <br />the owner being notified in writing by the City, the owner shall <br />provide to the City a documented time schedule and program <br />with rational to support the proposed amortization of the <br />building, structure, or use investments which will result in the <br />termination or correction of the nonconformity. <br /> <br />1. The termination/correction time schedule shall be based <br /> upon, but not limited to, factors such as the initial <br /> investment and the degree of threat or danger being posed. <br /> <br />2. The acceptability of the time schedule shall be determined <br /> by the Zoning Administrator with right of appeal. The <br /> Zoning Administrator shall use the following criteria to <br /> determine acceptability of the time schedule. <br /> (a) The length of time that the use has been operating. <br /> (b) The ease by which the property could be converted to a <br /> conforming use. <br /> (c) The nature and character of the surrounding <br /> neighborhood. <br /> (d) The value and condition of the improvements on the <br /> property. <br /> (e) The amount of the applicant's investment in the <br /> business. <br /> (f)The amount of investment already realized. <br /> (g)The cost of relocating the use. <br /> <br />3.
